Protester Action definition

Protester Action means any action taken or threatened to be taken by any person or persons protesting against the carrying out of any part of the Operations including construction of the New Works (or any part thereof) or of roads in general which directly or indirectly affects performance of the Operations including without limitation action or threatened action which results in:

Protester Action means any picketing, demonstration, blockade or other protester action (other than as a result of industrial action which affects only the employees of the Project Company or its Contractors or in respect of matters other than those arising from this Agreement or the Project to be constructed pursuant to this Agreement) taking place on the Project Site, or directly affecting access to the Project Site. Public Interest Criteria means the criteria to be taken into consideration by the Contracting Authority to fulfil its obligation to manage this Agreement in accordance with section 73(4) of the PPP Act.
