Public Note Indentures in this Section 1.01.
Public Note Indentures means (a) the Indenture dated as of August 15, 1993 between NCI and The Bank of New York, as Trustee, (b) the Indenture dated as of December 22, 1993 between NCI (as successor to Dial Call Communications, Inc.) and The Bank of New York, as Trustee, (c) the Indenture dated as of January 13, 1994 between NCI (as successor to CenCall Communications Corp.) and The Bank of New York, as Trustee, (d) the Indenture dated as of February 15, 1994 between NCI and The Bank of New York, as Trustee and (e) the Indenture dated as of April 24, 1994 between NCI (as successor to Dial Call Communications, Inc.) and The Bank of New York, as Trustee. In addition, effective on the Amendment No. 5 Effective Date, the term "Public Note Indentures" shall include the Indenture dated as of September 17, 1997 between NCI and Harrxx Xxxst and Savings Bank, as Trustee.
Public Note Indentures means (a) the Indenture dated as of August 15, 1993 between NCI and The Bank of New York, as Trustee, (b) the Indenture dated as of December 22, 1993 between NCI (as successor to Dial Call Communications, Inc.) and The Bank of New York, as Trustee, (c) the Indenture dated as of January 13, 1994 between NCI (as successor to CenCall Communications Corp.) and The Bank of New York, as Trustee, (d) the Indenture dated as of February 15, 1994 between NCI and The Bank of New York, as Trustee and (e) the Indenture dated as of April 24, 1994 between NCI (as successor to Dial Call Communications, Inc.) and The Bank of New York, as Trustee.

Examples of Public Note Indentures in a sentence

  • The PTRs, the Underlying Documents, and the Surveys shall be collectively referred to herein as the “Title Documents.” The Surveys will be modified to certify them to Buyer and Buyer’s lender and will contain a Surveyor’s Certification in the form attached hereto as Exhibit F, (at Seller’s sole cost and expense).

  • The aggregate outstanding principal amount of Existing Vendor Indebtedness that may be permitted to be outstanding under the "Motorola Agreements" and "Northern Telecom Agreements" in accordance with the definitions of such respective terms under the Public Note Indentures is $260,000,000 and $40,000,000, respectively.

  • NCI hereby designates each of the Commitments and Loans hereunder as the "Credit Facility" under and for all purposes of the Public Note Indentures.

  • In that connection, NCI hereby represents and warrants as of the date hereof that there is not currently in effect any designation of any other credit facility as a "Credit Facility" under any of the Public Note Indentures (other than, for periods prior to the Effective Date, the Existing Credit Agreement and Existing Vendor Financing Agreements).

Public Note Indentures shall include the Indenture dated as of September 17, 1997 between NCI and Harrxx Xxxst and Savings Bank, as Trustee.
Public Note Indentures means any indenture or similar instrument pursuant to which any Indebtedness of NCI is issued (whether before or after the Restatement Effective Date) in a registered public offering under the Securities Act of 1933, or pursuant to Rule 144A under said Act.

  • Senior Note Indentures means, collectively, the Senior Note (2020) Indenture, the Senior Note (2021) Indenture, the Senior Note (2022) Indenture and the Senior Note (2023) Indenture.

  • Subordinated Note Indenture means the Indenture dated as of the Closing Date, among the Borrower, the guarantors party thereto and The Bank of New York, as trustee, pursuant to which the Subordinated Notes are issued, as the same may be amended, supplemented or otherwise modified from time to time to the extent permitted by Section 10.7(b).

  • Public Notes means the Notes that have been registered under the Securities Act of 1933, as amended, or the securities laws of any other jurisdiction. As of the Closing Date, the Public Notes include the Class A Notes, the Class B Notes, the Class C Notes and the Class D Notes, other than any Notes held by the Depositor (or any other entity whose separate existence from the Trust is disregarded for federal income tax purposes).

  • Senior Notes Indentures means, collectively, the 2020 Senior Notes Indenture and the 2023 Senior Notes Indenture.

  • Senior Secured Notes Trustee means The Bank of New York Mellon Trust Company, N.A. and its successors and assigns acting as trustee under the Senior Secured Notes Indenture.
