To the extent that any term or provision of the Agreement is considered void ab initio or otherwise unenforceable against a Public Sector Customer pursuant to applicable law that expressly prohibits such Public Sector Customer from agreeing to such term or condition, then such conflicting term or provision in this Agreement shall be struck to the extent to make such term or provision enforceable, and the remaining language, if any, shall remain in full force and effect.

Public Sector Customer means a Customer that is an agency, organization, or other entity that is within (or is substantially owned, funded, managed or controlled by):

Once projects are identified, support will be provided to acquire funding, gain decisionmaker buy-in, manage projects through completion, and celebrate success. • CONTRACTOR Staff will brief CONTRACTOR Board of Directors, City Managers, and Public Works Directors on overall program updates and accomplishments on an as needed basis • The CONTRACTOR will work with an energy technical resource to facilitate EE technical support for member city integration of energy efficiency initiatives. • The CONTRACTOR, with the assistance of an energy technical resource, will support cities with On-bill financing as a mechanism for facilitating the purchase and installation of comprehensive, qualified energy efficiency measures. • The CONTRACTOR will coordinate with Company 3rd party programs to help provide introductions to the local public sector in an effort to speed up coordination time and drive gas, electric, and water savings. The CONTRACTOR will also coordinate with SoCalREN activities including energy benchmarking, energy audits, technical resources, incentive opportunities, and project discussion.
