Qualified Arbitrator definition

Qualified Arbitrator means a person or entity that is neither an Affiliate of Lessor, such Leasehold Mortgagee or Tenant nor interested in any financial manner in the outcome of the Arbitration Question or in Lessor, Tenant or any Leasehold Mortgagee and has at least ten (10) years experience as an owner or operator of nursing centers or hospitals or as a senior executive officer and/or director of the American Health Care Association and/or the Federation of American Health Systems or any successor organizations thereto or as a senior executive officer of a publicly traded healthcare real estate investment trust.
Qualified Arbitrator. As defined in Section 22.6(c).
Qualified Arbitrator means a person with at least ten years experience in the commercial real estate business, including experience with cellular tower assets.

Examples of Qualified Arbitrator in a sentence

  • If either Lessor or such Leasehold Mortgagee (for itself and Tenant) shall fail to appoint a Qualified Arbitrator within the aforesaid ten (10) day period, the Qualified Arbitrator appointed by the other shall alone proceed to determine the Arbitration Question.

  • If the parties agree on the selection of a Qualified Arbitrator, the mutually selected Qualified Arbitrator shall be appointed for the parties’ arbitration.

  • If the parties have not selected an arbitrator within thirty (30) days of written demand for arbitration, the Qualified Arbitrator shall be selected by the Boston office of the American Arbitration Association on application by either party.

  • If the parties are unable to mutually select a Qualified Arbitrator, they shall each select a Qualified Arbitrator and the two Qualified Arbitrators shall then select a third neutral Qualified Arbitrator who shall arbitrate the parties’ dispute.

  • Within ten (10) days of a demand for arbitration, the parties shall attempt to mutually agree on a Qualified Arbitrator.


More Definitions of Qualified Arbitrator

Qualified Arbitrator means an investment banking or appraisal firm of nationally recognized standing having the knowledge and experience necessary to make the Determination selected in accordance with the procedures set forth in the definition of Determination Process above.

Qualified Arbitrator means an arbitrator who meets the standards of impartiality and independence required by the JAMS Rules who has not been engaged or employed by any Party in any capacity within the prior two (2) years and who is experienced in arbitrating or otherwise deciding complex commercial or real estate issues.
Qualified Arbitrator means a person who is independent, disinterested and has not performed any legal, appraisal, auditing, valuation or other services for the Board of Managers or any party or any Affiliate of any party at any time during the five (5) year period prior to his or her selection and (a) for determinations of any real estate disputes, a licensed attorney who has devoted a substantial part of his or her practice, over ten (10) or more years, to commercial real estate matters in the New York City area relevant to the specific matter in dispute and is fully familiar with the AAA Arbitration Rules for the Real Estate Industry, (b) for determinations of any construction disputes, a licensed attorney who has devoted a substantial part of his or her practice, over ten (10) or more years, to construction law matters in New York City and is fully familiar with the Construction Industry Arbitration Rules and Arbitration Procedures of the AAA, or (c) for determination of all other disputes, a licensed attorney who has devoted a substantial part of his or her practice, over ten (10) or more years as a practicing attorney, arbitrator and/or judge, to drafting, negotiating and/or interpreting commercial leasing agreements and who is fully familiar with New York law and the Commercial Arbitration Rules of the AAA.
Qualified Arbitrator means a person who is an appraiser or real estate broker licensed by the State of California and who has not less than five (5) years' experience in commercial leasing or commercial real estate appraising.
Qualified Arbitrator means any of (a) an attorney licensed to practice law with at least ten years experience in handling complex international merger and acquisition and/or corporate transactions or commercial disputes; (b) a Certified Public Accountant with at least ten years experience with an internationally recognized public accounting firm or Fortune 500 corporation in handling complex international merger and acquisition and/or corporate transactions; or (c) an investment banker or senior corporate officer of a U.S. public company responsible for financial oversight of such public company with at least ten years experience in handling complex merger and acquisition and/or corporate transactions; provided, however, that in no event shall any Qualified Arbitrator be an employee, client or Affiliate of either Optionor, Optionee or the Principal Minority Stakeholders.
Qualified Arbitrator means an individual (i) having at least ten (10) years of professional experience with matters like that which is subject matter of the dispute being submitted to arbitration, and (ii) is neutral and shall have had no prior notice, information or discussions concerning the dispute and, at such time or for the previous ten (10) years, shall not have been employed by or associated with or agent of any Member or any Affiliate of either of them.
