Qualifying Family Member definition

Qualifying Family Member means the Beneficiary’s legal parent or the Beneficiary’s spouse or common-law partner as long as the Beneficiary is not living separate and apart from their spouse or common-law partner because of a marriage or common-law partnership breakdown.
Qualifying Family Member in relation to a Beneficiary of a Disability Savings Plan, at any time, means an individual who, at that time is:
Qualifying Family Member means the Union citizen’s spouse, a direct descendant of the Union citizen/spouse who is under the age of 21 or dependant on the Union citi- zen/spouse, and dependant direct relative of the Union citizen/spouse in the direct ascending line. The term ‘spouse’ does not include a party to a ‘marriage of convenience’. This latter term is not defined.

  • If, after reasonable inquiry, the Trustee of a disability savings plan is of the opinion that an individual's contractual competence to enter into a disability savings plan is in doubt, no action lies against the Trustee and/or the Agent for entering into a plan, under which the individual is the Beneficiary, with a Qualifying Family Member who is a Qualifying Person solely because of paragraph (c) of the definition of "Qualifying Person", above.


More Definitions of Qualifying Family Member

Qualifying Family Member means, in the case of an alien victim 21 years of age or older who is eligible for U nonimmigrant status as described in section 101(a)(15)(U) of the Act, 8 U.S.C. 1101(a)(15)(U), the spouse or child(ren) of such alien; and, in the case of an alien victim under the age of 21 who is eligible for U nonimmigrant status as described in section 101(a)(15)(U) of the Act, qualifying family member means the spouse, child(ren), parents, or unmar- ried siblings under the age of 18 of such an alien.
Qualifying Family Member means (i) the participant's spouse or children (including adopted children and step children) or (ii) a trust established for the exclusive benefit of such spouse and/or children who has been transferred options under the Plan pursuant to Section 15 hereof.
