This proceeding was initiated by a Petition for Resolution of Rate Dispute (Petition) dated August 22, 2022, filed by Charter Communications, Inc., Cogeco US Finance, LLC d/b/a Breezeline, and Comcast Cable Communications, LLC (collectively, the Petitioners).
Small Rate Dispute Methodology The Board has recognized that, for small disputes, the litigation costs required to bring a case under the Board’s existing rate reasonableness methodologies can quickly exceed the value of the case.
The extent of backdating does not appear to be limited to the date when the dispute was referred and, as Miss Lee pointed out, in the Termination Rate Dispute appeals the Tribunal did direct OFCOM to backdate the new charges to a date earlier than the date on which the disputes were referred3.

By an order dated 31 October 2007 in the Termination Rate Dispute Appeals and an order dated 20 November 2007 in H3G’s Appeal4 The BT Dispute Determinations were reissued on 19 July 2007 with some minor typographical errors corrected.against the Reassessment Statement and 2007 Statement, the Tribunal ordered that the overlapping issues in H3G’s Appeal and the Termination Rate Dispute Appeals be heard at a combined hearing in January and February 2008.
The Tribunal is handing down at the same time a separate judgment on the core issues in the Termination Rate Dispute appeals.
All of the Termination Rate Dispute appeals raised similar arguments alleging errors of law by OFCOM in the way it went about determining the disputes.
