Renewal Term Expiration Date definition

Renewal Term Expiration Date means the tenth anniversary of the commencement date of the Renewal Term.

Renewal Term Expiration Date which shall mean: (i) where the Renewal Term Commencement Date is the first day of a calendar month, the last calendar day of the thirty-ninth (39th) month after the Renewal Term Commencement Date measured by counting the month in which the Renewal Term Commencement Date occurs, or (ii) where the Renewal Term Commencement Date is other than the first day of a calendar month, the last calendar day of the thirty-ninth (39th) month after the Renewal Term Commencement Date measured without counting the month in which the Renewal Term Commencement Date occurs, or (iii) irrespective of whether item (i) or item (ii) applies, such earlier date upon which the Lease, as amended hereby, is terminated pursuant to the terms hereof.

Renewal Term Expiration Date shall have the meaning ascribed to it in Section 42.1 of this Lease.

• Upon request by Landlord or Tenant made on or following the Renewal Term Commencement Date, the requested party will execute, acknowledge and deliver to the requesting party an amendment to this Lease setting forth the Renewal Term Commencement Date, Fixed Rent for the Renewal Term, and the Renewal Term Expiration Date.

• In the event Tenant declines to exercise its option for any Renewal Term, Tenant shall provide written notice to Landlord (the “Non-Renewal Notice”) not later than one hundred and eighty (180) days prior to the Initial Term Expiration Date or the then current Renewal Term Expiration Date.
