Reviewing Representative definition

Reviewing Representative means a person who has signed a Nondisclosure Certificate and who is:

Reviewing Representative means a party or a party’s Counsel, Employee or Outside Consultant who has obtained access to Stamped Confidential Documents or to Stamped Highly Confidential Documents pursuant to paragraphs 5, 6, or 8 of this Protective Order.

Reviewing Representative means a person who has signed a Non-Disclosure Certificate and who is: (1) an employee or other representative of [Requesting Entity] who needs access to the CEII to carry out the purpose set forth in Paragraph 1; or (2) a consultant or an employee of a consultant retained by [Requesting Entity] who needs access to the CEII for the purpose identified in Paragraph 1.

Examples of Reviewing Representative in a sentence

• Within five (5) business days after receiving written notice of the identity of any Reviewing Representative, the Disclosing Party may provide the Requesting Party with a written objection to a specific Reviewing Representative stating the grounds for the objection.

• Failure by the Disclosing Party to object within five (5) business days does not waive the Disclosing Party’s right to later object to the Reviewing Representative, even if Protected Materials has already been disclosed.

• Even if a Reviewing Representative is no longer engaged in this proceeding, every such person shall continue to be bound by the provisions of this Protective Order and the Nondisclosure Certificate.

• If a Disclosing Party objects to a specific Reviewing Representative within five (5) business days after the Reviewing Representative is identified, the Parties shall not provide any Protected Materials to the disputed Reviewing Representative until the Parties are able to resolve the dispute consistent with the dispute resolution procedures in Paragraph 11.

• Any dispute concerning whether an identified person or entity is an appropriate Reviewing Representative shall be resolved through the dispute resolution procedures in Paragraph 11 of this Protective Order.

More Definitions of Reviewing Representative

Reviewing Representative means a person who has executed this Agreement or any other person that has executed a Confidentiality Agreement for the purpose of receiving Confidential and Protected Material and/or CEII provided by SPP.

Reviewing Representative means: (1) with respect to materials other than Highly Sensitive Protected Materials, a person who has signed a Non-Disclosure Certificate and who is: (i) an attorney retained by a Party for purposes of this Schedule 17 Pre-Filing Review Process; (ii) attorneys, paralegals, and other employees associated for purposes of this Schedule 17 Pre-Filing Review Process with an attorney described in Paragraph 3(c)(1)(i); (iii) an expert or an employee of an expert retained by a Party for the purpose of advising, preparing for or testifying in this Schedule 17 Pre-Filing Review Process; or (v) employees or other representatives of a Party with significant responsibility for matters involving this proceeding. (2) For purposes of reviewing Highly Sensitive Protected Materials covered by Paragraph 3(a)(1), a person who has signed a Non-Disclosure Certificate and who is: (i) A member or staff of any state or local utilities commission or the New England States Committee on Electricity; (ii) An outside attorney who is representing a Party in this Schedule 17 Pre-Filing Review Process; (iii) An attorney, paralegal, or other employee of the firm of the outside attorney described in Paragraph 3(c)(2)(ii) working with such outside attorney for purposes of this case; or (iv) An outside expert or an employee of an outside expert retained by a Party for the purpose of advising, preparing for or participating in this Schedule 17 Pre-Filing Review Process who is working under the direction of an attorney described in Paragraph 3(c)(2)(ii) or 3(c)(2)(iii) and who is not Competitive Duty Personnel.

Reviewing Representative means a person who has executed this Agreement or any other person that has executed a Confidentiality Agreement for the purpose of receiving Confidential and Protected Material provided by DTO.

Reviewing Representative means a person who has signed a Non-Disclosure Certificate and who is:

Reviewing Representative means a person who has signed aNon- Disclosure Certificate and who is: (1) Commission Trial staff designated as such in this Proceeding; (2) an attorney retained by a Party for purposes of the Proceeding; (3) attorneys, paralegals, and other employees associated for purposes of the Proceeding with an attorney described in Paragraph (4)(c)(1); (4) an expert or an employee of an expert retained by a Party for the purpose of advising, preparing for, submitting evidence or testifying in the Proceeding; (5) a person designated as a Reviewing Representative by order of the Commission; or (6) employees or other representatives of a Party with significant responsibilityfor matters involving the Proceeding.

Reviewing Representative means a person who has signed a Non- Disclosure Certificate and who is: (1) an attorney who is representing Participant in the above-captioned proceeding; (2) attorneys, paralegals, and other employees associated for purposes of the above-captioned proceeding with an attorney described in Subparagraph (1); (3) an expert or an employee of an expert retained by Participant or attorney for Participant for the purpose of advising, preparing for or testifying in the above-captioned proceeding; (4) employees of Participant with primary responsibility to represent Participant’s interest in the above-captioned proceeding; or (5) a person designated as a Reviewing Representative by order of the Commission.

Reviewing Representative means a person who has signed a Non-Disclosure Certificate or who may otherwise review Confidential Materials pursuant to Section 6 below.
