Securities Collateral Value definition

Securities Collateral Value means, as of any date of determination, the market value of the Securities Collateral as determined by Maker and Payee. If the common stock of Maker is listed on any stock exchange or trading publicly, the market value of the Securities Collateral as of any date of determination shall be conclusively determined by the average daily price for the common stock of Maker as measured over the course of the sixty (60) day period prior to such date of determination, provided further that prior to the day upon which the common stock of Maker is listed on any stock exchange or trading publicly the market value of the Securities Collateral as of any date of determination shall be conclusively determined by using $1.58 as the price for the common stock of the Maker.
Securities Collateral Value means, as of any date of determination, the market value of the Securities Collateral as determined by Maker and Payee. If the common stock of Maker is listed on any stock exchange, the market value of the Securities Collateral as of any date of determination shall be conclusively determined by the weighted average volume daily price for the common stock of Maker as measured over the course of the sixty (60) day period prior to such date of determination, provided further that prior to the day upon which the common stock of Maker is listed on any stock exchange the market value of the Securities Collateral as of any date of determination shall be conclusively determined by using $1.00 as the price for the common stock of Maker.
