References in this Agreement to actions taken or to be taken by the Servicer in performance of the Servicer Duties include actions taken or to be taken by a Subservicer on behalf of the Servicer.
The duties of the Backup Servicer set forth in Section 8A.2 (the "Backup Servicer Duties") shall be conducted by the Person so designated from time to time as Backup Servicer in accordance with this Agreement.
