All Monetary Awards to Individual Plaintiffs, Individual Settlement Administration Expenses (except as specified in Section 3.1.5), and payments to Subrogating Insurers or for medical or other liens for Individual Plaintiffs, if any, as to Released Claims, and payments or amounts due on Holdback Claims per Section 8.3, shall be paid exclusively from the Individual Settlement Fund.
Defendants will be responsible for, in addition to the Aggregate Settlement Amount, 50% of the Individual Settlement Administration Expenses, up to a cap of $15 million, which shall be known as the Defendants’ IP Administration Share.

The amount remaining from the Gross Settlement Amount after the above-described deductions for (i) Class Representative Service Payment, (ii) Class Counsel Fees Payment, (iii) Class Litigation Expenses Payment, (iv) Settlement Administration Expenses Payment, (v) LWDA PAGA Payment, and (vi) Individual PAGA Payments is the Net Settlement Amount.
The Parties agree that if Costco withdraws, the Settlement shall be void ab initio, having no force or effect whatsoever, and that neither Party will have any further obligation to perform under this Agreement; provided, however, Costco will remain responsible for paying all Settlement Administration Expenses incurred to that point.
