Settlement Approval Date definition

Settlement Approval Date means the date on which the Approval Order is issued.
Settlement Approval Date means the business day after all of the following conditions have been satisfied: (i) notice of this Rule 23(b)(2) Class Settlement Agreement has been provided to the members of the Rule 23(b)(2) Class as provided in Paragraphs 95-99 below and ordered by the Court; and (ii) the Court has entered the Rule 23(b)(2) Class Settlement Order and Final Judgment without substantial modification from the form contained in the attached Appendix F, including without modification of the definition of the Rule 23(b)(2) Class (from which exclusions are not permitted), and including without any modification of the release and covenant not to sue provided by the Rule 23(b)(2) Class.
Settlement Approval Date means the date on which the Settlement Agreement is approved by both the Tokyo District Court and the Bankruptcy Court.

  • At such time as the United States Supreme Court refuses to extend NextWave's time to respond and all other available means of obtaining deferral have been exhausted, all Parties that are also parties to the certiorari proceedings agree to file a joint motion to defer consideration of the petitions for certiorari until after the Final Bankruptcy Settlement Approval Date.

  • The effectiveness of the Commission’s obligation to make the NextWave Payment and its delivery of the Payment Notice and NextWave’s surrender and return of the Designated Licenses together with the relinquishment of any and all claims to the Covered Spectrum and the Designated Licenses shall occur simultaneously on or before the tenth Business Day following the Final Bankruptcy Settlement Approval Date, but not later than December 31, 2002.

  • Subject to the other terms and conditions of this Settlement Agreement, the Parties and their respective counsel shall use reasonable efforts to cause the Court to give Preliminary Approval to this Settlement Agreement as promptly as practical, to take all steps contemplated by this Settlement Agreement that are necessary to effectuate the Settlement on the stated terms and conditions, and to obtain Final Approval of this Settlement Agreement and achieve a Final Settlement Approval Date for the settlement.
