Survival of Provisions After Termination. (1) If this Settlement Agreement is not approved, is terminated or otherwise fails to take effect for any reason, the provisions of Sections 3.1(8), 3.2(3), 4.1(6)(b), 5.1(3), 5.2, 5.3, 5.4, 8.1, 8.2, 10.1(2) and 11.2(4), and the definitions and Schedules applicable thereto shall survive the termination and continue in full force and effect. The definitions and Schedules shall survive only for the limited purpose of the interpretation of Sections 3.1(8), 3.2(3), 4.1(6)(b), 5.1(3), 5.2, 5.3, 5.4, 8.1, 8.2, 10.1(2) and 11.2(4), within the meaning of this Settlement Agreement, but for no other purposes. All other provisions of this Settlement Agreement and all other obligations pursuant to this Settlement Agreement shall cease immediately.

Survival of Provisions After Termination. ‌ (1) If this Settlement Agreement is not approved, is terminated, or otherwise fails to take effect for any reason, Sections 3.1(7), 3.2(5), 5.2 (in so far as it relates to the investment, distribution or administration of monies in the Trust Account, including Administration Expenses, or administration of the distribution protocol), 6.1(2), 6.2, 6.3, 6.4, 9.1, 9.2, 10.1(4), 11.1(3), 11.2, 12.2(7), 13.3 (in so far as it relates to Administration Expenses or any lien of any person on any payment to any settlement class member from the settlement amount), 14.1, 14.2, 14.3, 14.4, 14.5, 14.6, 14.7, 14.8, 14.9, 14.10, 14.11, 14.12, 14.13, 14.15, 14.16 and 14.17, and the definitions applicable thereto (but only for the limited purpose of the interpretation of those sections) shall survive the termination and continue in full force and effect. All other provisions of this Settlement Agreement and all other obligations pursuant to this Settlement Agreement shall cease immediately.

(2) The Releasees and the Releasors expressly reserve all of their respective rights if the Settlement Agreement is terminated.

Survival of Provisions After Termination. If this Settlement Agreement is not approved by the Ontario Court, is terminated in accordance with its terms, or otherwise fails to take effect for any reason, the provisions of this section, sections 8.2, 11, 12.1 to 12.13 and 12.15 to 12.17, and the Recitals, Definitions, and Schedules applicable thereto shall survive the termination and continue in full force and effect.

The definitions shall survive only for the limited purpose of the interpretation of sections 4.1(c), 4.2, 4.3(b), 4.3(c), 6.2, 7.1, 7.2, 8.1, 8.2, 8.3, 8.4, 13.2 and 13.5 within the meaning of this Agreement, but for no other purposes. All other provisions of this Agreement and all other obligations pursuant to this Agreement shall cease immediately. (b) The Defendants and the Plaintiff expressly reserve all of their respective rights if this Agreement does not become effective or if this Agreement is terminated.

Survival of Provisions After Termination. If this Settlement Agreement is not approved, is terminated, or otherwise fails to take effect for any reason, the provisions of paragraphs 47 through 49 and the definitions and Schedules applicable thereto shall survive the termination and continue in full force and effect. The definitions and Schedules shall survive only for the limited purpose of the interpretation of paragraphs 47 through 49 within the meaning of this Settlement Agreement, but for no other purposes. All other provisions of this Settlement Agreement and all other obligations pursuant to this Settlement Agreement shall cease immediately.
