Other Purposes. For the Plan Year in which an Employee enters the Plan, the Employee's Compensation which shall be taken into account for purposes of the Plan (other than ADP or ACP testing) shall be (Choose one):
Other Purposes. The Company may engage in activities related or -------------- incidental to its principal purpose, as well as any other business or investment activity as may be approved by the affirmative Vote of all Members. However, as provided in the Act, the Company may not engage in the business of granting policies of insurance, assuming insurance risks, issuing debt instruments for circulation as money or receiving deposits of money.
Other Purposes. A member of the bargaining unit may be granted a leave of absence without pay for educational, professional, or other purposes. At the discretion of the member, such leave shall be for (a) the balance of the school year or (b) the balance of the school year and the next ensuing school year. Upon written request, the Board may grant an extension of such leave for one additional school year. Such leaves as is provided in this subsection shall be granted in accordance with the section and Section 3319.13 of the Revised Code.
Other Purposes. The Company may engage in activities related or incidental to its principal purpose. In addition, as provided in the Act, the Company is subject to other applicable Laws which govern or limit the conduct of a particular business or activity.
Other Purposes. 7.1 Notwithstanding clauses 4.4 and 6.5, we will not be restricted in how we use Customer Data or Feedback where:
7.1.1 we have obtained the same data from third parties, including from the Customers themselves;
7.1.2 we are required to use such data in a particular way, or retain it, by applicable law;
7.1.3 we retain such data as part of our business continuity and disaster recovery processes and procedures; or
7.1.4 we require such data to bring or defend potential claims made by third parties.
Other Purposes. The Company may engage in activities related or incidental to its principal purpose, as well as any other lawful business or investment activity as may be approved by the unanimous Vote of the Members.
Other Purposes. The Performance Bond Security Fund shall also serve as security for:
(a) The faithful performance by Company of all terms, conditions and obligations of this Agreement;
(b) Any expenditure, damage, or loss incurred by City occasioned by Company’s failure to comply with all rules, regulations, orders, permits and other directives of City and City issued pursuant to this Agreement;
(c) Payment of compensation set forth in Section 7 hereof;
(d) The payment of premiums for the liability insurance required pursuant to Section 10 hereof;
(e) The removal of the System from the Right-of-Way of City at the termination of the Agreement, at the election of City, pursuant to Section 11.4 hereof;
(f) The payment to City of any amounts for which Company is liable pursuant to Section 10.1.1 hereof which are not paid by Company's insurance;
(g) The payment of any other amounts which become due to City pursuant to this Agreement or law;
(h) The timely renewal of the letter of credit that constitutes the Performance Bond/Security Fund; and
(i) Any costs, losses or damages incurred by City as a result of a default of Company's obligations under this Agreement.
Other Purposes. To make or cause to be made disbursements for any other purpose which is declared in such instructions to be a proper trust purpose; provided, however, that before making any such disbursement Northern shall have received a copy of a resolution of the Trustees certified by the Secretary of the Trust specifying the amount of such disbursement, setting forth the purpose for which such disbursement is to be made, declaring such purpose to be a proper trust purpose and naming the person(s) to whom the disbursement is to be made.
Other Purposes. 1. Upon written request of an employee, leave of absence may be granted for purposes other than those set forth in this Article. Terms of all leave of absence shall be set forth in writing. Any employee who undertakes or continues other work or employment during any leave of absence without first securing written permission from the Employer and the Union, automatically cancels such leave of absence and will be considered to have terminated his employment. Failure to return to work in accordance with the terms of a leave of absence shall be cause for immediate termination.
2. The Employer agrees to grant a leave of absence up to thirty (30) days in the case of personal emergencies or death in the employee’s immediate family.
Other Purposes. 1. Upon written request of an employee, leave of absence may be granted for purposes other than those set forth in this Article. Terms of all leaves of absence shall be set forth in writing. Any employee who accepts or solicits other employment during such leave of absence shall be subject to discharge.
2. The Employer agrees to grant a leave of absence up to thirty (30) days in the case of personal emergencies or death in the employee’s immediate family.
3. The Employer agrees that employees will be granted leaves of absence connected with state and federal law provided all terms and conditions provided for in the law qualify an employee for any said leave.
