Technical Document definition

Technical Document means recorded Information that conveys scientific and Technical Information or Technical Data.

Technical Document means any technical reference, technical publication, AT&T Practice, BA Practice, Bellcore Practice, publication of telecommunications industry administrative or technical standards, or other similar document, which is specifically incorporated into this Agreement.

Technical Document means any recorded information including reports, working documents related to the service, including concepts, reports of a technical or other nature, photographs, drawings, plans, specifications and software which may or may not be protected by the copyright.

FOR ANY VALID CLAIM PRESENTED UNDER THIS AGREEMENT, SELLER WILL REPLACE THE PRODUCT, OR AT ITS OPTION, REFUND THE PURCHASE PRICE. THIS REPLACEMENT/REFUND REMEDY IS THE PURCHASER'S SOLE AND EXCLUSIVE REMEDY AGAINST SELLER. THE PURCHASER AGREES THAT NO OTHER REMEDY (INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST SALES, INJURY TO PERSON OR PROPERTY OR ANY OTHER SPECIAL, INCIDENTAL, OR CONSEQUENTIAL LOSS OR DAMAGE) SHALL BE AVAILABLE TO PURCHASER FOR CLAIMS ARISING OUT OF ANY USE OF THE PRODUCT REGARDLESSS OF THE LEGAL THEORY (CONTRACT, CIVIL LIABILITY TORT [INCLUDING NEGLIGENCE] OR OTHER). IN NO EVENT WILL SELLER BE OBLIGATED TO PAY DAMAGES TO PURCHASER FOR ANY AMOUNT EXCEEDING THE PRICE THAT PURCHASER PAID FOR THE PRODUCT. Purchaser is required to review the specific context of the intended use to determine whether their intended use violates any law or infringes upon any patent.
