the Port definition

the Port means a new port to be established in implementation of proposals made by the Joint Venturers pursuant to Clause 7 whether the same be established by the Joint Venturers exclusively or by them in conjunction with another or others (including the State) and should no such new port be established the term means any existing port developed or used by the Joint Venturers for the purposes of this Agreement by arrangement with another or others (including the State) and in either case the term extends to and includes as well as the land upon which the Joint Venturers’ wharf is erected also the adjacent land serving the Joint Venturers’ wharf and the adjacent land on which it is proposed to locate or on which could be located or in fact is located secondary and tertiary processing plants crushing grinding and screening facilities stockpiling yards electric power generating plant petroleum storage and other ancillary facilities;
the Port means the Port of Liverpool as defined in The Mersey Docks and Harbour Act 1971 or any statutory modification or re-enactment thereof.

Examples of the Port in a sentence

  • Each of the following shall be considered a "Default" by Tenant of this Lease: (i) If the Tenant shall fail to pay rent, leasehold excise tax, and other legitimate costs as set forth herein, after ten (10) days' written notice, the Port may, at is option, declare this Lease cancelled and forfeited, and the Tenant's right to possession ended.

  • In such event, Tenant shall give the Port written notice of its intention not to restore the Premises within (30) days from the date of the destruction, this Lease shall be deemed terminated as of the date of such notice, and Tenant shall release to the Port the portion of the insurance proceeds relating to Tenant's permanent improvements.

  • The proceeds of such sale to be applied first to the costs of such sale, second to the payment of the charges for storage, and third to the payment of any other amounts which may be then due from the Tenant to the Port.

  • The Tenant shall pay such deficiency upon demand by the Port after the amount thereof is ascertained by the Port.

  • Or the Port may place the same in a public garage or warehouse, all at the expense and risk of the owners thereof.
