Lease Administration. Lessor’s Unit Manager, Xxxxxxx Xxxxxxxx, or his successor, Gwinn Management Unit, 000 Xxxx X-00, Xxxxx, XX 00000 is the Lease Administrator (Lessor’s Representative) as pertains to the terms and conditions of the Lease as well as compliance with the terms and conditions of the Lease. Xxxxxx designat es as Xxxxxx’s Representative, and designates as alternate Xxxxxx’s Representative as responsible to be the contacts for Xxxxxx regarding operations under the Lease. These contacts shall be authorized to make decisions regarding the maintenance and operation of the Premises for the Lessee. Each party will notify the other in case of a change in their respective representatives.
Lease Administration. This Lease shall be administered on behalf of County by the Department of Public Works – Real Property, County of Santa Xxxx, or by such person's duly- authorized designee (referred to collectively herein as "County's Lease Administrator"), and on behalf of Lessee by: Director of Libraries, Santa Xxxx Public Libraries, 000 Xxxxx Xxxxxx, Xxxxx Xxxx, XX 00000, 831-427-7700 ext. 7611, or by such other person as may be designated in writing by Xxxxxx (referred to collectively herein as "Lessee's Lease Administrator").
Lease Administration. This Lease shall be administered on behalf of County by the Director, Department of General Services or a designee (collectively, the “County’s Lease Administrator”), and on behalf of Lessee by or by another person designated in a written Notice by Lessee (the “Lessee’s Lease Administrator”).
Lease Administration. Internal legal fees of the MARC Entities shall be reimbursable at a reasonable hourly rate but in no event shall the total fee paid be in excess of $1,500 for a Lease renewal and $5,000 for a new Lease; provided, however, if any third-party legal fees relating to such Lease renewal or new Lease shall be payable by the Property Owner, such amount otherwise payable for internal legal fees shall be 50% of the foregoing amounts, in each case, subject to adjustment based on the CPI Adjustment.
Lease Administration. Following execution of a lease and beneficial occupancy of the Premises, the Contractor will be responsible for the following elements of the administration of the lease.
a. Collection of all rent, fees, fund contributions, reimbursements, and any liquidated damages due under the lease. All monies due will be properly accounted for and reported; and monies shall be forwarded to the Authority as provided for herein.
b. Ensuring that Concession Operators meet the insurance requirements contained in Exhibit 6, Standard Provisions.
c. Analysis of Concession Operators’ financial performance and prompt identification to the Authority of any potential problems. The Contractor shall inform the Authority if a Concession Operator is in default and what action, formal or informal, against the Concession Operator is contemplated. Copies of all correspondence relating to the default and any legal actions filed by the Contractor relating to the default shall be provided to the Authority.
d. Coordination with the Authority on concession advertising and promotions.
e. Promptly providing for the temporary and/or permanent re-leasing of any Premises that become vacant.
f. Ensuring that Concession Operators are compliant with lease terms
Lease Administration. Promptly and diligently enforce the Owner’s rights under any tenant leases affecting any Property, including without limitation taking the following actions where appropriate: (i) with the Owner’s prior consent: (a) terminating tenancies, (b) instituting and prosecuting actions, and evicting tenants, (c) settling, compromising and releasing actions or suits, or re-instituting tenancies, and (d) recovering rents and other sums due by legal proceedings in a court of general jurisdiction; and (ii) without the Owner’s prior written consent: (a) in a court of special jurisdiction as applicable, signing and serving notices as are deemed necessary by Manager, and (b) recovering rents and other sums due by legal proceedings in a court of similar jurisdiction. In each case Manager will promptly notify the Owner of such action in writing. If authorized by the Owner, Manager will consult an attorney for the purpose of enforcing the Owner’s rights or taking any actions and the Owner shall have the right to designate counsel for any matter and to control all litigation affecting or arising out of the operation of any Property. Manager will keep Owner informed of any dissatisfaction with the law firm or services, or the reasonableness of the costs.
Lease Administration. All communications about this lease shall be directed as follows, and any reliance on a communication with a person other than that listed below is at the party’s own risk.
