Therapeutic Licensed Product definition

Therapeutic Licensed Product means a Licensed Product that is used to prevent, treat or cure one or more diseases and/or conditions of humans.
Therapeutic Licensed Product means any therapeutic product except therapeutic or prophylactic vaccines (which are specifically excluded from the definition of THERAPEUTIC LICENSED PRODUCT), used for a therapeutic purpose that, in whole or in part: (i) absent the license granted hereunder, would infringe one or more claims of the PATENT RIGHTS; or (ii) is manufactured by using a LICENSED PROCESS or that, when used, practices a LICENSED PROCESS.
Therapeutic Licensed Product means a LICENSED PRODUCT that is used for a therapeutic and/or prophylactic purpose, e.g., an antiviral agent or a vaccine.

Examples of Therapeutic Licensed Product in a sentence

  • In the event that the period described in clause (b) of the preceding sentence extends beyond the period described in clause (a) of the preceding sentence with respect to a Therapeutic Licensed Product in a country (a “Therapeutic Product Extended Period”), then the royalty rate of [***]% set out above will be reduced to [***]% of Net Sales of such Therapeutic Licensed Product in such country during such Therapeutic Product Extended Period.

More Definitions of Therapeutic Licensed Product

Therapeutic Licensed Product means any product, service and/or process which constitutes, is based on, incorporates or utilizes, wholly or in part, Licensed Technology, any and all Derivatives and/or any and all Biological Materials and is used to treat or cure human disease.

Therapeutic Licensed Product means any Licensed Product, the composition of matter of which is claimed by at least one Valid Claim included in the Patent Rights or any Licensed Service that uses such Licensed Product. For the avoidance of doubt, any Licensed Product covered by a claim that combines screening, composition of matter and/or method of use in the same claim, shall be considered a Therapeutic Licensed Product.

  • Licensed Product means a product or part of a product in the Licensed Field of Use: (A) the making, using, importing or selling of which, absent this license, infringes, induces infringement, or contributes to infringement of a Licensed Patent; or (B) which is made with, uses or incorporates any Technology.

  • Licensed producer means an agent, broker, or reinsurance intermediary licensed pursuant to the applicable provision of the insurance law of any jurisdiction.

  • Marijuana product means marijuana as defined in 50-32-101 and marijuana-infused products
