VNXX Traffic shall be subject to the originating carrier’s originating access rates which shall be payable by the Party providing VNXX Service.

For purposes of determining the relative use factor, the terminating carrier is responsible for ISP-Bound traffic and the Party that provides a VNXX Service shall be responsible for any VNXX Traffic facilitated by such VNXX Service.
As such, except as provided by PUC Order No. 07- 098, the Parties will not knowingly provide VNXX Service in Oregon or knowingly aid the other Party in providing VNXX Service in Oregon.
VNXX Traffic is not EAS/Local Traffic for purposes of intercarrier compensation and a Party providing a VNXX Service is not entitled to TELRIC rates for transport facilities to the extent they are used for routing such VNXX Traffic.
VNXX Traffic (including any VNXX Traffic which is ISP-Bound Traffic) shall be subject to the originating carrier’s originating access rates which shall be payable by the Party providing VNXX Service.
For purposes of this Agreement, “VNXX Traffic” is defined only as traffic delivered to a VNXX Service.
Neither Party shall provide VNXX Services unless the Party providing such VNXX Service first notifies the other Party.

A Party whose End User is assigned a telephone number that falls within this definition, including any End User of its wholesale customers, is the Party that provides the VNXX Service. “Virtual NXX Traffic” (“VNXX Traffic”) refers to calls originated from or terminated to an NPA- NXX-XXX that was assigned using a VNXX Service.
