LONG-TERM DEBT, Continued On June 20, 2012, the joint power authority, Marin Municipal Water District Financing Authority issued the 2012 Series A Water Revenues Bonds in the amount of $85,000,000 to refund the District’s outstanding 2002 Water Revenue Bonds and a portion of the 2004 Certificant of Participation.
In order to comply with bond covenants the City is required to charge Water and Sewer rates such that Net Wastewater Revenues and Net Water Revenues are in excess of Debt Service payments by a specific percentage.
In the event of the Contracting Jurisdiction’s failure to pay said xxxx(s) when due, without waiving any other remedies under this Uniform Water Agreement, said unpaid xxxx(s) shall become obligations payable from the Water Revenues of the Contracting Jurisdiction and shall be collectible in any court of law.

All of the Bonds and Parity Debt are equally secured by a pledge of, and charge and lien upon, all of the Subordinated Water Revenues, and the Subordinated Water Revenues constitute a trust fund for the security and payment of the interest on and principal of the Bonds; but nevertheless out of Subordinated Water Revenues certain amounts may be applied for other purposes as provided in the Indenture.
