Xxxxxx Tenant definition

Xxxxxx Tenant means a Subsidiary of Xxxxxx that is the lessee under any lease of a Real Property Asset at any time. On the Effective Date, the Xxxxxx Tenants are listed on Schedule DT hereto.
Xxxxxx Tenant shall have the meaning set forth in the definition of Xxxxxx Lease.

  • If Owner commences legal proceedings against Xxxxxx, Tenant may be required to deposit rent into court.

  • Upon execution and delivery of this Lease by Xxxxxx, Tenant shall deposit the Security Deposit with Landlord as security for the performance by Tenant of all of Tenant’s obligations contained in this Lease.

  • Tenant acknowledges that Xxxxxx has inspected the Premises, the Buildings and the Property or has had the Premises, the Buildings and the Property inspected by professional consultants retained by Xxxxxx, Tenant is familiar with the condition of the Premises, the Buildings and the Property, the Premises, the Buildings and the Property are suitable for Tenant’s purposes, and the condition of the Premises, the Buildings and the Property is acceptable to Tenant.

  • Landlord covenants that if Xxxxxx performs and observes the covenants hereunder to be performed or observed by Xxxxxx, Tenant shall peaceably and quietly have, hold and enjoy the Demised Premises during the Demised Term.

  • If the agreed or confirmed audit shows an underpayment of Operating Expenses by Xxxxxx, Tenant shall pay to Landlord, within thirty (30) days after the audit is agreed to or confirmed, the amount owed to Landlord, and, if the agreed or confirmed audit shows an overpayment of Operating Expenses by Xxxxxx, Landlord shall reimburse Tenant for such overpayment within thirty (30) days after the audit is agreed to or confirmed.

  • In the event that Xxxxxx’s security deposit is used to pay for damage caused by Tenant or to cover unpaid rent owed by Xxxxxx, Tenant must immediately deposit with Landlord a new security deposit if Tenant wishes to continue to reside in the premises.

  • If Tenant requests the consent or approval of Landlord to any assignment, sublease or other action by Xxxxxx, Tenant shall pay on demand to Landlord all costs and expenses, including, without limitation, reasonable attorneys’ fees, incurred by Landlord in connection therewith.

  • If such statements are found to be incorrect to an extent of more than three (3%) percent over the figures submitted by Xxxxxx, Tenant shall pay for such special audit; otherwise, the cost of such audit shall be paid by Landlord.

  • When giving notice to Xxxxxx, Tenant has the burden of proving delivery to Lessor.

  • If CP is not available at the time requested by Xxxxxx, Tenant may also call a locksmith at Tenant’s expense.

Related to Xxxxxx Tenant

  • Sublandlord means the holder of sublandlord’s interest under this Sublease. In the event of any assignment or transfer of the Sublandlord’s interest under this Sublease, which assignment or transfer may occur at any time during the Term in Sublandlord’s sole discretion, Sublandlord shall be and hereby is entirely relieved of all covenants and obligations of Sublandlord hereunder accruing subsequent to the date of the transfer and it shall be deemed and construed, without further agreement between the parties hereto, that any transferee has assumed and shall carry out all covenants and obligations thereafter to be performed by Sublandlord hereunder. Sublandlord may transfer and deliver the then existing Letter of Credit to the transferee of Sublandlord’s interest under this Sublease, and thereupon Sublandlord shall be discharged from any further liability with respect thereto. In addition, Sublandlord shall comply with all of its obligations as “Tenant” under the Master Lease except to the extent that any such obligation is the obligation of Subtenant pursuant to the terms of this Sublease. Notwithstanding any other term or provision of this Sublease, the liability of Subtenant to Sublandlord for any default in Subtenant’s obligations under this Sublease shall be limited to actual, direct damages, and under no circumstances shall Sublandlord, its partners, members, shareholders, directors, agents, officers, employees, contractors, sublessees, successors and/or assigns be entitled to recover from Subtenant (or otherwise be indemnified by Subtenant) for lost revenues, lost profit or other consequential, special or punitive damages arising in connection with this Sublease for any reason, except for any breach by Subtenant under Section 12 of the Master Lease. Notwithstanding any other term or provision of this Sublease, no personal liability shall at any time be asserted or enforceable against Subtenant’s shareholders, directors, officers, or partners on account of any of Subtenant’s obligations or actions under this Sublease.

  • Tenant means a person entitled under a rental agreement to occupy a dwelling unit to the exclusion of others.
