COMPANY will be responsible for the handling of the day-to-day operations at the Zone Site.
Tenant shall have the nonexclusive right to use those spaces depicted on the Loading Zone Site Plan attached hereto as Exhibit "I".

This Agreement shall remain in effect so long as the FTZ Site is designated and activated as a Foreign Trade Zone Site by the FTZ Board and Customs.
The Other Party shall indemnify the State against all claims (of whatever kind) of third parties in respect of loss suffered which can be attributed to the construction, operation, and/or removal of ▇▇▇▇▇▇▇▇▇ ▇▇▇▇ (noord) Wind Farm Zone, Site V by or on behalf of the Other Party.
If the Rezone Request is approved and once a specific Site Plan Approval has been approved, Developer shall have the vested right to develop and construct the Project in accordance with and subject to compliance with the terms and conditions of this Agreement, the C-4 Zone, Site Plan requirements and other applicable provisions of the Code as of the Effective Date.
GRANTEE shall have the right upon notice and during normal business hours at any time and from time to time, at its own cost and expense, to conduct inspections and audits of COMPANY's records in connection with its operations at the Zone Site.
All financial and operations information concerning COMPANY’s activities at the Zone Site shall be kept confidential except that which is required to be made public by the FTZB or any other public agency.
