DELIVERY AND TRANSPORT. Delivery time is indicated on the order confirmation, and it corresponds to the day of shipment. Scirocco H is committed to meet the delivery time but cannot give absolute guarantees. Claims for compensation relating to breach of the terms cannot be taken into consideration; in the event of force majeure (strikes, riots, accidents, natural disasters, etc.), Scirocco Hreserves the right to chose the measures to be taken. Shipments are made ex-works. The goods always travel at the risk and peril of the Customer even if sold FOB. In the absence of clear and unambiguous provisions in this regard, the Seller Company will assign the goods to its carriers deemed appropriate, without any whatsoever liability. Scirocco H is deemed relieved from any liability in case of missing and damaged items. The Seller Company is not liable for damages occurred to goods during transport, since these must be disputed to the carrier; the shipping document must bear signature subject to control that needs to be specific, thus showing the discovered anomaly, since the general reserve relieves the carrier from any liability. Furthermore, the claim must be received within and not later than 8 days from unloading of the goods.
DELIVERY AND TRANSPORT. 6.1 The delivery terms shall be counted in working days starting from the date of the order confirmation. 6.2 Unless otherwise agreed in writing, delivery terms are purely indicative and not binding and, in any case, are only valid under normal working and raw material supply conditions; any delays in delivery shall not entitle the Company to indemnity and/or compensation of any kind. 6.3 The delivery terms will be automatically extended (for a period at least correspon- ding to the ascertained delay), or must be redefined between the parties, in the fol- lowing cases: a) delayed payment by the Customer of any amount due as an advance payment; b) changes to the supply agreed between the parties following the confir- mation of the order; c) proven difficulties on the part of the Company in procuring raw materials; d) events of force majeure.
