TERMS OF USE – DISCLAIMER. Each Service is provided by C1V Hosting to the Client on the basis of the technical network solutions available at the time of conclusion of the Contract and the Service Order. In order to guarantee the integrity and security of the Service, C1V Hosting, to the extent that it is necessary to safeguard the network in favour of other users, reserves the right to temporarily modify the parameters of the Service, subject to notice to the Client, also by introducing temporary and non-discriminatory mechanisms to limit the use of network resources. In order to safeguard the network in the interest of all users, C1V Hosting, by registered mail with acknowledgement of receipt, certified e-mail, or ordinary e-mail, will invite all those who improperly use the network to use it in line with the chosen profile. In the event that, following 2 (two) reports sent by C1V Hosting regarding the improper use of the Service by the Customer, C1V Hosting reserves the right to intervene, at its own discretion, in the most appropriate manner for the situation, including the termination of the contract. In the event of breakdowns and/or malfunctions of the equipment and/or network functional to the provision of the C1V Hosting Service, due to unforeseeable circumstances or force majeure or extraordinary maintenance related to exceptional and unforeseeable external events, C1V Hosting will have the right to suspend the Service as a precautionary measure at any time, in whole or in part, even in the absence of prior notice. In such cases, C1V Hosting is not responsible for any loss, damage or prejudice suffered for any reason by the Client. In any case, C1V Hosting will not be responsible for interruptions, malfunctions or delays in the provision of services due to: • particular weather conditions; • incorrect use of the Service by the Client; • malfunction, unsuitability or lack of approval of the Customer's equipment and/or accessories; • tampering, intervention or repair carried out by the Customer or by third parties not authorized by the Supplier; • use of the Service in a manner that is inconsistent with this agreement and the individual Service order; • force majeure, total or partial interruption of access services or termination of the connection, if due to force majeure or the act of a third party.
