Common use of LIABILITY Clause in Contracts

LIABILITY. 5.1. Should Supplier be late delivering Products without a reasonable explanation, while the Buyer is performing his agreed duties, the Supplier is required to pay the Buyer liquidated damage fee equal to 0.3% of the total amount of delayed products per day. The fee is payable up to 3% of a total Contract value. 5.2. If the Buyer fails to make payment of the Contract, he pays to the Supplier liquidated damages equivalent to the 0.3% of the Contract price for each week of the delay up to a maximum 3% of the Contract Price.
