Common use of LIABILITY Clause in Contracts

LIABILITY. 5.1. Should Supplier be late delivering Products without a reasonable explanation, while the Buyer is performing his agreed duties, the Supplier is required to pay the Buyer liquidated damage fee equal to 0.3% of the total amount of delayed products per day. The fee is payable up to 3% of a total Contract value.
