Centro Paroquial de Assistência de Freixo de Espada à Cinta, com sede na Av. Guerra Junqueiro, 000 0000-000 Freixo de Espada à Cinta, pessoa coletiva n. º 500 867 860, representada pelo Senhor Xxxxx Xxxxxx Xxxxxxx Xxxxx como Presidente, Xxxxxx Xxxxxxx Xxxxxxxxx como Secretária e Xxx Xxxxx Xxxxxx Xxxxxx Xxxxx como Tesoureira, de ora em diante designada por Primeira Contraente;
Konica Minolta Business Solutions Portugal, Unipessoal Lda, com sede na Xxx Xxxxxxxxx Xxxxxxxx xx Xxxxxx, xx 0, 00x X, 0000-000 Xxxxx Xxxxx, representada por Xxxx Xxxxxxxx Xxxxxxxxx xx Xxxxx, cartão de cidadão nº 00000000 0XX0, válido até 31/07/2029, que outorga na qualidade de procurador, com poderes conferidos para o ato, de ora em diante designado por Segundo Contraente;
CLÁUSULA 1.ª OBJETO DO CONTRATO
O presente contrato tem por objeto a contratação de serviços de cópia, impressão e digitalização e o aluguer de diverso material informático, incluindo assistência técnica e fornecimento de consumíveis.
Este contrato é precedido por consulta prévia e adjudicado ao segundo outorgante, em conformidade com o caderno de encargos, devidamente aprovado;
CLÁUSULA 2.ª PRAZO DE EXECUÇÃO
O prazo de vigência do presente contrato é de 35 (trinta e cinco) meses a contar da data da sua celebração, não se renovando na data do seu termo;
CLÁUSULA 3.ª PREÇO CONTRATUAL
Pelo serviço previsto na cláusula 1ª, o Primeiro Outorgante obriga-se a pagar ao segundo outorgante o valor mensal de 570,00 € (quinhentos e setenta euros) acrescido de IVA à taxa legal em vigor, o que inclui um volume de 1500 páginas a P&B e 500 páginas a cor.
Por cada cópia / impressão excedente a preto praticar-se-á um valor de 0,0066 € e por cada cópia / impressão excedente a cores um valor de 0,06 €.
CLÁUSULA 4ª PAGAMENTOS
As faturas vencem-se no prazo de 60 dias após a receção das mesmas pelo contraente público.
Os acertos do número de páginas efetivamente produzidas pelos equipamentos serão efetuados semestralmente após apresentação de relatórios de consumo, tendo por base os valores constantes da proposta
CLÁUSULA 5ª
CAUÇÃO
Não é exigível a prestação de caução de acordo com o no 2 do artigo 88º do CCP.
CLÁUSULA 6ª
FORO COMPETENTES
Para resolução de todos os litígios decorrentes do contrato fica estipulada a competência do Tribunal Administrativo e Fiscal de Mirandela, com expressa renúncia a qualquer outro.
CLÁUSULA 7ª
PREVALÊNCIA
Consideram-se como condições a observar no serviço, as expressas no contrato, os suprimentos dos erros e das omissões do Caderno de Encargos, desde que esses erros e omissões tenham sido expressamente aceites pelo órgão competente para a decisão e contratar, os esclarecimentos e as retificações relativos ao Convite, Caderno de Encargos e na proposta apresentada pelo segundo outorgante.
Em caso de divergência entre os documentos referidos no número anterior, prevalece em primeiro lugar os suprimentos dos erros e das omissões do Caderno de Encargos, desde que esses erros e omissões tenham sido expressamente aceites pelo órgão competente para a decisão de contratar, os esclarecimentos e as retificações relativos ao Convite, Caderno de Encargos, seguidamente a proposta apresentada pelo segundo outorgante, e em último lugar o texto do presente contrato, nos termos do disposto no n. °6, do artigo 96. °, do CCP.
CLÁUSULA 8ª
LEGISLAÇÃO APLICÁVEL
A tudo o que não esteja previsto no presente contrato aplica-se o disposto no Código dos Contratos Públicos, aprovado pelo Decreto-Lei n. 0 18/2008, de 29 de janeiro, na sua atual redação e demais legislações aplicáveis.
CLÁUSULA 9ª
DISPOSIÇÕES FINAIS
Os pagamentos a efetuar ao abrigo do presente contrato serão efetivados após a verificação dos formalismos legais em vigor para o processamento das despesas públicas.

From time to time, Konica Minolta Business Solutions Portugal Unip. Lda (we, us or Company) may be required by law to provide to you certain written notices or disclosures. Described below are the terms and conditions for providing to you such notices and disclosures electronically through the DocuSign system. Getting paper copies
At any time, you may request from us a paper copy of any record provided or made available electronically to you by us. Withdrawing your consent
If you decide to receive notices and disclosures from us electronically, you may at any time change your mind and tell us that thereafter you want to receive required notices and disclosures only in paper format. How you must inform us of your decision to receive future notices and disclosure in paper format and withdraw your consent to receive notices and disclosures electronically is described below.
Consequences of changing your mind
If you elect to receive required notices and disclosures only in paper format, it will slow the speed at which we can complete certain steps in transactions with you and delivering services to you because we will need first to send the required notices or disclosures to you in paper format, and then wait until we receive back from you your acknowledgment of your receipt of such paper notices or disclosures. Further, you will no longer be able to use the DocuSign system to receive required notices and consents electronically from us or to sign electronically documents from us.

Unless you tell us otherwise in accordance with the procedures described herein, we will provide electronically to you through the DocuSign system all required notices, disclosures, authorizations, acknowledgements, and other documents that are required to be provided or made available to you during the course of our relationship with you. To reduce the chance of you inadvertently not receiving any notice or disclosure, we prefer to provide all of the required notices and disclosures to you by the same method and to the same address that you have given us. Thus, you can receive all the disclosures and notices electronically or in paper format through the paper mail delivery system. If you do not agree with this process, please let us know as described below. Please also see the paragraph immediately above that describes the consequences of your electing not to receive delivery of the notices and disclosures electronically from us.

Acknowledging your access and consent to receive and sign documents electronically
