4Reporting. (a) The Provider will, in accordance with the Information, Records and Reporting Policy, give the Principal information about and report on the Services provided to the School as agreed in the Work Plan and Position Description and otherwise as requested by the Principal including information about: (i) how many hours of Services were provided; (ii) how many students have accessed the Services; (iii) any complaints or concerns identified with regard to the Chaplain or Student Wellbeing Officer or the provision of the Services; (iv) aggregated data about the nature of the Services provided; (v) any other information requested by the Australian Government. (b) The Provider will also provide the Principal with information and records that relate to the delivery of Services as requested by the Principal in order for the School to meet any obligations the School has to account for the expenditure of funds.

4Reporting. In the event that Purchaser’s due diligence reveals any condition of the Property that in Purchaser’s judgment requires disclosure to any governmental agency or authority, Purchaser shall immediately notify Seller thereof. In such event, Seller, and not Purchaser or anyone acting on Purchaser’s behalf, shall make such disclosures as Seller deems appropriate. Notwithstanding the foregoing, Purchaser may disclose matters concerning the Property to a governmental authority if, (a) in the written opinion of Purchaser’s outside legal counsel, Purchaser is required by law to make such disclosure, and (b) Purchaser gives Seller not less than ten (10) days prior written notice of the proposed disclosure, together with a copy of such legal opinion; provided, however, that if, pursuant to applicable law, Purchaser is obligated to make such disclosure before the end of such ten (10) day period, Purchaser shall provide Seller with such written notice and legal opinion as far in advance of the legally required disclosure as is reasonably practicable. Contractor shall maintain such insurance in force and effect throughout the term of the contract. 1. 3The failure of the State to obtain a Certificate of Insurance, for the policies required under this Contract or renewals thereof, or failure of the insurance company to notify the State of the cancellation of policies required under this Contract shall not constitute a waiver by the Owner to the Contractor to provide such insurance. 1. 4The State reserves the right to immediately terminate the contract if the contractor is not in compliance with the insurance requirements and retains all rights to pursue any legal remedies against the contractor. All insurance policies must be open to inspection by the State, and copies of policies must be submitted to the State’s authorized representative upon written request.
