Acceptance of Rejection of Products. Committed Greenhealth Exchange Participants shall have twenty (20) business days from the date of delivery in which to inspect the Product(s) and to accept or reject such Product(s). In the event the Committed Greenhealth Exchange Participant, after such inspection, rejects the Product(s) due to discovery of non- conforming product or broken or damaged Products or packages containing Products, the Committed Greenhealth Exchange Participant shall notify Seller within the twenty (20) business days at the Committed Greenhealth Exchange Participant’s option, full credit of purchase price or replacement of the damaged Product(s). This provision shall in no way limit the remedies available for Seller’s failure to satisfy quality standards pursuant to Section 4.15, below. Return Goods Policy The Greenhealth Exchange participant must request authorization through the Haworth Order Services department within ninety (90) days of product receipt to return unused product. If Haworth agrees to repurchase the product, the customer must return it freight prepaid to Haworth, CPT the original shipping point (for returns from international destinations, must be returned freight prepaid to Haworth, D.D.P., the original shipping point) or as otherwise instructed by Haworth Order Services. If product is returned without a Return Authorization Haworth will notify the customer of the unauthorized return and the customer must provide instructions within one (1) week on disposal (i.e., return to dealer at dealer’s expense, or Haworth dispose of product with no credit offered). Return authorization expires sixty (60) days after date of issue. The customer must promptly provide a purchase order or other acceptance of fees/credit reduction as required.

The State’s Project Manager will apply the standards established in Exhibit D and the acceptance criteria set forth in subparagraph B of this article, as appropriate, to determine the acceptability of the Deliverable provided by Contractor. Acceptance Criteria for Deliverables (“Criteria”) provided by Contractor pursuant to this Agreement include: Timeliness: The Work was provided on time; according to schedule; Completeness: The Deliverable contained all of the, Data, Materials, and features required by the Agreement; and Technical accuracy: The Deliverable complied with the standards of this Agreement, or, if this Agreement lacks a standard for provision of the Work, the currently generally accepted industry standard. Contractor shall provide the Deliverable to the State, in accordance with direction from the Project Manager and as provided for in Exhibit D. The State shall accept the Deliverable, provided that Contractor has delivered the Deliverable in accordance with the Criteria. The State’s Project Manager shall assign the Acceptance and Signoff Form to notify Contractor of the Deliverable’s acceptability. If the State rejects the Deliverable provided, the State’s Project Manager shall submit to Contractor’s Project Manager a written rejection describing in detail the failure of the Deliverable as measured against the Criteria. If the State rejects the Deliverable, then Contractor shall have a period of ten (10) Business Days from receipt of the Notice of rejection to correct the stated failure(s) to conform to the Criteria.

  • Acceptance of Services Services furnished under this Contract are subject to acceptance by OSU. If OSU finds services furnished to be incomplete or not in compliance with the Contract, OSU, at its sole discretion, may either reject the services, require Contractor to correct any defects without charge, or negotiate with Contractor to reduce the price, whichever OSU deems appropriate under the circumstances. If Contractor is unable or refuses to cure any defects within a time deemed reasonable by OSU, OSU may reject the services and cancel the Contract in whole or in part.
