ACCESS TO COURTS. Notwithstanding the provisions of paragraphs 8.1 and 8.2 above, any action by Netgateway to enforce its rights under Paragraphs 10.1 or 10.3 of this Agreement or to enjoin any infringement of the same by Subscriber may, at Netgateway's election, be commenced in the state or federal courts of Los Angeles, California, and Subscriber consents to personal jurisdiction and venue in such courts for such actions.
ACCESS TO COURTS. CONTRACTOR shall provide inmates access to courts in compliance with the ACA Standards and the United States Constitution.
ACCESS TO COURTS. The CONTRACTOR will ensure all CDCR Offender court related access is in compliance and consistent with the provisions of Department Operations Manual and California Code of Regulations, Title 15. The CONTRACTOR will provide opportunity for meaningful access to federal and California State legal materials at the Facility in accordance with security and operating needs. Every attempt should be made by the CONTRACTOR to provide CDCR Offenders in segregation and protective custody access to the law library collection established pursuant to this section providing their participation is consistent with the safety and security of the Facility. If direct access cannot be provided CDCR Offenders in segregation or protective custody, a process shall be established allowing CDCR Offenders in segregation or protective custody to request reasonable numbers of materials from a law library. The CONTRACTOR shall provide CDCR legal materials required to meet constitutional standards via computer and appropriate software including California specific material. The CONTRACTOR shall provide a secure and monitored location to house said computer and associated peripherals. The CONTRACTOR shall provide federal law material; typewriters, including ribbons, and typing paper; notary services; copying services, including copier paper; legal size envelopes; sufficient to meet constitutional standards. Items such as paper and typewriters shall be provided and shall be available free of charge to indigent CDCR Offenders. CDCR Offenders need not be afforded access to copiers; however, the CONTRACTOR shall provide a copy of specific information, such as a page from a law book, upon request by a CDCR Offender. A common copy fee shall be set by the CONTRACTOR. The CONTRACTOR shall provide access to law material when staff has scheduled absences, due to vacations, extended leave or training.
ACCESS TO COURTS. Either Party may at any time apply to a court with appropriate jurisdiction only to (a) seek interim or provisional relief necessary to protect its rights or property pending the resolution of a Dispute in accordance with these procedures, including injunctive relief and specific performance, or (b) enter or enforce any final and binding arbitration award.
ACCESS TO COURTS. Each Party shall in its territory accord to investors of another Party treatment no less favourable than the treatment which it accords to its own investors or investors of a non-party with respect to the jurisdiction of its courts as well as its administrative tribunals and agencies, both in pursuit and in defence of investors’ rights.
ACCESS TO COURTS. The CDCR shall ensure all COUNTY Youthful Offenders have court related access consistent with the CDCR regulations and policies. All COUNTY Youthful Offenders requesting access to a law library, beyond what is available at the Fire Camp, shall be transported back to the COUNTY in accordance with Section II, Subsection C. Any court order to produce a COUNTY Youthful Offender that is presented to the COUNTY shall immediately be forwarded to the CDCR Headquarters for processing. The COUNTY is responsible for transportation and costs thereof for local, state, and federal court appearances. If sufficient advanced notice is provided, CDCR may transport in accordance with Section II, Subsection C.
ACCESS TO COURTS. Nothing in Section 10(a) will preclude a party’s recourse to a court of competent jurisdiction to: (i) enforce an arbitration award under this Section; (ii) seek temporary equitable relief necessary to protect its interests; or (iii) recover specific property, including an action to recover property.
ACCESS TO COURTS. The County will provide all CDCR inmates with court access in the same manner as it is to County inmates.
ACCESS TO COURTS. Contractor agrees to provide Department offenders in Contractor' s custody under this Contract meaningful access to the courts through: (a) the use of court appointe d attorneys to satisfy their Sixth Amendment right to counsel, (b) access to contracted attorneys provided by the Department, and/or (c) access to legal resource materials at the Facility. The Contractor also agrees to provide Department offenders opportunity to access legal materials at the Facility or to access the Department offender's attorney in accordance with security and operating needs and consistent with access granted to Contractor inmates.
ACCESS TO COURTS. CONTRACTOR shall provide inmates access to courts in compliance with the United States Constitution, Florida Statutes, Florida Administrative Code and DC policy and procedures.
