Access to Designated Record Set. Blue Cross and Blue Shield will provide access, at the request of the Plan, and on terms mutually agreeable to the Plan and Blue Cross and Blue Shield, to Protected Health Information in a Designated Record Set, to the Plan or, as directed by the Plan, to an individual in order to meet the requirements under 45 C.F.R. § 164.524.
Access to Designated Record Set. To the extent that the Companymaintains PHI in a “Designated Record Set,” as such term is defined in 45 CFR §164.501, on behalf of Covered Entity, the Companyshall make the PHI in the Designated Record Set available to the Covered Entity so that the Covered Entity may meet its access obligations under 45 CFR §164.524. If the Covered Entity requests an electronic copy of PHI that is maintained by the Company electronically in a Designated Record Set, the Companywill provide an electronic copy in the form and format specified by the Covered Entity unless it is not readily producible in suchformat, in whichcase it shall be produced in standard hard copy format. The Company may charge a reasonable cost-based fee for copying the Designated Record Set.
Access to Designated Record Set. Individuals have a right to access any protected health information that is used to make decisions about the individual subject of the data, including information used to make healthcare decisions or information used to determine whether a claim will be paid. The individual has a right to access their "designated record set.” The right of access also applies to healthcare clearinghouses, healthcare providers that create or receive protected IIHI other than as a business associate of Cass County. For Cass County’s purposes, the following is defined as a "designated record set:" A group of records maintained by Cass County that is: a) the medical records and billing records about individuals; b) the enrollment, payment, claims adjudication and case management record systems maintained by Cass County; c) used, in whole or in part, by or for Cass County to make decisions about individuals.
Access to Designated Record Set. To the extent that information is in the control of BCBSNE, BCBSNE will provide access to Protected Health Information as required by 45 CFR § 164.524 on THE PLAN's behalf. BCBSNE will provide such access according to its own procedures for such access. Such provision of access will not relieve THE PLAN of any additional and independent obligations to provide access where requested by an individual. BCBSNE represents that its procedures for such access comply with the requirements of 45 CFR § 164.524. BCBSNE shall make such information available in an electronic format where directed by THE PLAN. Accordingly, BCBSNE will make available for inspection and copying by THE PLAN, or by the individual (or the individual’s personal representative), any Protected Health Information about the individual created or received for or from THE PLAN in BCBSNE's custody or control contained in a Designated Record Set. BCBSNE may charge the individual reasonable fees related to this access, as determined by BCBSNE and as permitted by HIPAA.
Access to Designated Record Set. The Parties do not intend for Business Associate to maintain any PHI in a Designated Record Set for Covered Entity. To the extent Business Associate possesses PHI in a Designated Record Set, Business Associate agrees to provide access, at the request of Covered Entity, to PHI in a Designated Record Set, to Covered Entity or, as directed by Covered Entity, to an Individual in order to meet the requirements under 45 C.F.R. § 164.524. Business Associate is not required to provide such access where the PHI contained in a Designated Record Set is duplicative of the PHI contained in a Designated Record Set possessed by Covered Entity. If an Individual makes a request for access pursuant to 45 C.F.R. § 164.524 directly to Business Associate, or inquires about his or her right to access, Business Associate will either forward such request to Covered Entity or direct the Individual to Covered Entity.

If Business Associate maintains PHI in a Designated Record Set, Business Associate agrees to provide access, at the request of Covered Entity, to PHI in a Designated Record Set, to Covered Entity or, as directed by Covered Entity, to an Individual in order to meet the requirements under 45 C.F.R. § 164.524.

To the extent that Physicians Insurance RRG maintains PHI in a “Designated Record Set,” as such term is defined in 45 CFR § 164.501, on behalf of Covered Entity, Physicians Insurance RRG shall make the PHI in the Designated Record Set available to the Covered Entity so that the Covered Entity may meet its access obligations under 45 CFR § 164.524. If the Covered Entity requests an electronic copy of PHI that is maintained by Physicians Insurance RRG electronically in a Designated Record Set, Physicians Insurance RRG will provide an electronic copy in the form and format specified by the Covered Entity unless it is not readily producible in such format, in which case it shall be produced in standard hard copy format. Physicians Insurance RRG may charge a reasonable cost-based fee for copying the Designated Record Set.

At the request of Covered Entity, and in the time and manner designated by Covered Entity, Business Associate shall provide access to Protected Health Information in a Designated Record Set to Covered Entity, or as directed by Covered Entity, or to an Individual, in order to meet the requirements of 45 CFR § 164.524.
Access to Designated Record Set. Business Associate agrees to provide access to the Covered Entity, or to an Individual or an Individual's designee as directed by the Covered Entity, to PHI contained in a Designated Record Set in the time and manner designated by the Covered Entity. If an individual requests an electronic copy of PHI maintained electronically in a Designated Record Set, Business Associate agrees to provide access to the Covered Entity, or to an Individual or an Individual's designee as directed by the Covered Entity, to PHI in a readable electronic form and format as agreed to by the Covered Entity and the Individual, with respect to the PHI maintained electronically in a Designated Record Set.
Access to Designated Record Set. Subcontractor Business Associate agrees to provide access to the Business Associate, or to an Individual or an Individual's designee as directed by the Business Associate, to PHI contained in a Designated Record Set in the time and manner designated by the Business Associate. If an individual requests an electronic copy of PHI maintained electronically in a Designated Record Set, Subcontractor Business Associate agrees to provide access to the Business Associate, or to an Individual or an Individual's designee as directed by the Business Associate, to PHI in a readable electronic form and format as agreed to by a covered entity and the Individual, with respect to the PHI maintained electronically in a Designated Record Set.
