Common use of Accident or Injury Leave Clause in Contracts

Accident or Injury Leave. ‌ An employee who is eligible to receive Illinois Worker's Compensation temporary disability benefits for a period of absence from employment may elect whether to take sick leave benefits or Worker's Compensation benefits during the period of disability. If the employee elects to take paid sick leave during the period of disability, said employee shall turn over to the District the amount of Worker's Compensation benefits received. If the employee elects to take the Worker's Compensation benefits during the period of disability, the said employee shall not have any reduction of accumulated sick leave credit. An employee who has exhausted his or her sick leave shall not receive a salary and shall not be required to turn over to the School District any Worker's Compensation benefits which he or she receives.
