Common use of Accident Prevention Health and Safety Committee Clause in Contracts

Accident Prevention Health and Safety Committee. (a) The Employer and the Union agree that they mutually desire to maintain standards of safety and health in the workplace in order to prevent accidents, injury and illness. (b) Recognizing its responsibilities under the applicable legislation, the Employer agrees to accept as a member of its Accident Prevention – Health & Safety Committee at least three (3) representatives, one from each base, selected or appointed by the Union from amongst bargaining unit employees. At any time where a vote is required, an equal number of representatives from each side shall be entitled to vote. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. (d) The Employee agrees to co-operate reasonably in providing necessary information to enable the Committee to fulfill its functions. (e) Meetings shall be held quarterly or more frequently at the call of the Chair if required. The Committee shall maintain minutes of all meetings and make the same available for review. (f) Any representative appointed or select in accordance with (b) hereof shall serve a term of one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. The Union will encourage its representative(s) to serve at least one (1) year. Time off for such representative(s) to attend meetings of the Accident Prevention – Health & Safety Committee in accordance with the foregoing shall be granted and time so spent attending such meetings shall be deemed to be work time for which the representative(s) shall be paid by the Employer at his regular or premium rate as may be applicable. (g) The Union agrees to endeavour to obtain the full co-operation of its membership in the observation of all safety rules and practices. (h) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee’s physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred to in Article 16.04

(b) Recognizing its responsibilities under the applicable legislation, the Employer Hospital agrees to accept as a member of its Accident Prevention – - Health & and Safety Committee at least three one (31) representatives, one from each base, selected representative elected or appointed by the Union from amongst bargaining unit employees. At any time where a vote is required, an equal number of representatives from each side shall be entitled to vote. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. (d) The Employee Hospital agrees to co-operate cooperate reasonably in providing necessary information to enable the Committee committee to fulfill its functions. In addition, the Hospital will provide the committee with reasonable access to all accident reports, health and safety records and any other pertinent information in its possession. (e) Meetings shall be held quarterly every second month or more frequently at the call of the Chair Chair, if required. The Committee shall maintain minutes of all meetings and make the same available for review. (f) Any representative appointed or select elected in accordance with (b) hereof shall serve for a term of at least one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. The Union will encourage its representative(s) to serve at least one (1) yearappointment. Time off for such representative(s) to attend meetings of the Accident Prevention – Health & and Safety Committee in accordance with the foregoing foregoing, shall be granted and time so spent any representative(s) attending such meetings during their regularly scheduled hours of work, shall be deemed to be work time for which the representative(s) shall be paid by the Employer at his not lose regular or premium rate earnings as may be applicablea result of such attendance. (g) The Union agrees to endeavour endeavor to obtain the full co-operation cooperation of its the membership in the observation of all safety rules and practices. (h) All time spent by a member of the Accident Prevention Health and Safety Committee attending meetings of the Committee and carrying out her duties, shall be deemed to be work time for which she shall be paid by the Hospital at her regular rate and she shall be entitled to such time from work as is necessary to attend scheduled meetings. i) Pregnant employees may request to be transferred from their current duties ifduties, if in the professional opinion of the employee’s 's physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred current contractual pregnancy leave. j) Where the Hospital identifies high-risk areas where Employees are exposed to in Article 16.04infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to the employees.

(j) The Company will recognize April 28 as the annual day of remembrance for workers killed, injured or have contracted a work related disease on the job. Subject to the requirements of patient care, the Company agrees to stop work and provide a minute of silence for all employees at 11:00 A.M. April 28, in memory of workers killed or injured on the job. The Company will announce on its public address system at 11:00 a.m., April 28 that all employees will be observing a minute of silence in memory of workers killed or injured in the job.

Accident Prevention Health and Safety Committee. (b) Recognizing its responsibilities under 25.02 A joint management and employee Health and Safety Committee shall be constituted with representatives of at least half by employees for the applicable legislationvarious Bargaining Units and of employees who are not represented by the Unions and who do not exercise managerial functions. The objective of this committee shall be to identify potential dangers, recommend means of improving the health and safety programs, and obtain information from the Employer agrees to accept as a member or other persons respecting the identification of its Accident Prevention – Health & Safety Committee hazards and standards elsewhere. The committee shall meet at least bi- monthly. An agenda will be presented by the parties no less than three (3) representatives, one from each base, selected or appointed by days prior to the Union from amongst bargaining unit employeesmeeting. At any Scheduled time where a vote spent in such meetings is required, an equal number of representatives from each side to be considered time worked. Minutes shall be entitled to vote. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. (d) The Employee agrees to co-operate reasonably in providing necessary information to enable the Committee to fulfill its functions. (e) Meetings shall be held quarterly or more frequently at the call of the Chair if required. The Committee shall maintain minutes of all meetings and make copies sent to the same available for reviewEmployer and to the Union. 25.03 Two (f2) Any representative appointed or select in accordance with (b) hereof shall serve a term representatives of the Joint Health and Safety Committee, one (1) calendar year from the date of appointment which may be renewed for further periods of management and one (1) year. The Union will encourage its representative(s) to serve at least one (1) year. Time off for such representative(s) to attend meetings from the employees on a rotating basis, designated by the employees, shall make monthly inspections of the Accident Prevention – work place and equipment and shall report to the Health & and Safety Committee in accordance with the foregoing results of their inspection. In the event of accident or injury such representatives shall be granted notified immediately and shall investigate and report as soon as possible to the committee and the Employer on the nature and causes of the accident or injury. Furthermore, such representatives must be notified of the inspection of a government inspector and shall have the right to accompany him on the inspection. Scheduled time so spent attending in all such meetings activities shall be deemed to be work considered as time for which the representative(s) shall be paid by the Employer at his regular or premium rate as may be applicableworked. 25.04 The Joint Health and Safety Committee and the representatives thereof shall have reasonable access to the annual summary of data from the Workplace Safety & Insurance Board (gWSIB) relating to the number of work accident fatalities, the number of non-fatal cases and required medical aid without lost workdays, the incidence of occupational injuries, and such other non-confidential data as the WSIB may decide to disclose. 25.05 The Union agrees to endeavour to obtain the full co-operation cooperation of its membership members in the observation of all safety rules and practices. (h) Pregnant 25.06 The Employer will use its best efforts to make all affected direct case employees aware of residents who have serious infectious diseases. The nature of the disease need not be disclosed. The direct caseworkers however, are obligated to maintain confidentiality in respect to this information. Employees who are not direct care employees will be made aware of special procedures required of them to deal with these circumstances. The parties agree that all employees are aware of the requirement to practice universal precautions in all circumstances. 25.07 The Employer shall ensure that all employees are informed that they have the right to refuse work that they reasonably believe may request to endanger them or another worker. This right cannot be transferred from their current duties ifexercised however when the refusal would directly endanger the life, health or safety of another person. Signs will be posted in the professional opinion workplace advising employees of the employee’s physician, the pregnancy may be their right to refuse work. 25.08 Each year on April 28th at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, 1100 hours work will stop and one (1) minute of silence will be granted observed in memory of workers injured or killed on the job. 25.09 In the case of an unpaid leave outbreak an employee who has not taken such vaccination or treatment as would enable her to work without presenting a hazard to residents, shall be placed on a level of absence before commencement and shall be entitled to access any accrued vacation during such leave. An employee who does not take the recommended course of treatment for verified medical or bona fide religious reasons is entitled to such accommodation as the maternity Employer may direct or, failing that, sick leave referred to in Article 16.04if the credits are available.

(c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. (d) . The Employee Hospital agrees to co-operate reasonably in providing pro- viding necessary information to enable the Committee to fulfill its functions. (e) . Meetings shall be held quarterly every second month or more frequently fre- quently at the call of the Chair chair if required. The Committee shall maintain minutes Minutes of all meetings and make the same available for review. (f) . Any representative appointed or select selected in accordance with (b) hereof shall serve for a term of one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. The Union will encourage its representative(s) to serve at least one (1) year. Time off for such representative(s) to attend meetings of the Accident Prevention – Health & and Safety Committee in accordance with the foregoing shall be granted and time so spent attending such meetings shall be deemed to be work time for which the representative(s) representative shall be paid by the Employer Hospital at his regular or premium rate as may be applicable. (g) . The Union agrees to endeavour to obtain the full co-operation of its membership in the observation of all safety rules and practices. (h) . Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee’s 's physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred to in Article 16.04It is understood that the word "feasible" as set out above does not include bumping. Where the Hospital identifies high risk areas where employees are exposed to Hepatitis the Hospital will provide, at no cost to the employees, a vaccine to Hepatitis B Surface Antigen. The Hospital agrees to continue its present practices with respect to the provision of protective clothing and safety devices to employees, where applicable, subject to the provisions set out below with respect to safety footwear. The Hospital further agrees to meet directly with the representative of the Union or through the Accident Prevention Committee to discuss the need for any protective clothing or safety equipment in addition to that which the Hospital is presently providing. Effective date of ratification and on that date for each subsequent year, the Hospital will provide thirty-five dollars ($35.00) per year to each full-time employee who is required by the Hospital to wear safety footwear during the course of his duties.

(d) The Employee Hospital agrees to co-operate reasonably in providing necessary information to enable the Committee to fulfill fulfil its functions. (e) Meetings shall be held quarterly every second month or more frequently at the call of the Chair Chair, if required. . f) The Committee shall maintain minutes of all meetings and make the same available for review. Any Representative(s) Any representative appointed or select selected in accordance with (b) hereof hereof, shall serve for a term of or one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. The Union will encourage its representative(s) to serve at least one (1) year. Time off for such representative(sRepresentative(s) to attend meetings of the Accident Prevention – - Health & and Safety Committee in accordance with the foregoing shall be granted and time so spent attending such meetings shall be deemed to be work time for which the representative(sRepresentative(s) shall be paid by the Employer at his his/her regular or premium rate as may be applicable. (g) The Union agrees to endeavour to obtain the full co-operation of its membership in the observation of all safety rules and practices. (h) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee’s 's physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred to in Article 16.0415.04. i) Where the Hospital identifies high risk areas where employees are exposed to Hepatitis B, the Hospital will provide, at no cost to the employees, a Hepatitis B vaccine. j) The Employer agrees to undertake if proven that VLF & ELF is required for employee protection that it will be provided. The Occupational Health and Safety Committee will research this and make a recommendation.

(e) Meetings shall be held quarterly every third month or more frequently at the call of the Chair Chair, if required. The Committee shall maintain minutes of all meetings and make the same available for review. (f) Any representative appointed or select selected in accordance with (b) hereof hereof, shall serve for a term of at least one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. The Union will encourage its representative(s) to serve at least one (1) year. Time off for such representative(s) to attend meetings of the Accident Prevention – Health & Safety Committee in accordance with the foregoing shall be granted and time so spent attending such meetings shall be deemed to be work time for which the representative(s) shall be paid by the Employer at his regular or premium rate as may be applicableappointment. (g) The Union agrees to endeavour endeavor to obtain the full co-operation cooperation of its membership in the inthe observation of all safety rules and practices. (h) Pregnant employees may request All time spent by a member of the Accident Prevention-Health and Safety Committee attending meetings of the Committee and carrying out her duties, shall be deemed to be transferred work time for which she shall be paid by the Employer at her regular rate and she shall be entitled to such time from their current duties ifwork as is necessary to attend scheduled meetings. (i) Where as a condition of employment, in the professional opinion of Employer requires its employees to receive medication/immunization wherein they may be exposed to infections or communicable diseases, such medications and immunizations shall be provided by the Employer at no cost to the employee’s physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred to in Article 16.04.

Accident Prevention Health and Safety Committee. (a) The Employer and the Union agree that they mutually desire to maintain standards of safety and health in the workplace Hospital in order to prevent accidents, injury and illness. (b) Recognizing . its responsibilities under the applicable legislation, the Employer Hospital agrees to accept as a member of its Accident Prevention – Health & and Safety Committee at least three (3) representatives, one from each base, representative selected or appointed by the Union from amongst bargaining unit employees. (d) . The Employee Hospital agrees to co-operate reasonably in providing necessary information to enable the Committee to fulfill fulfil its functions. (e) . Meetings shall be held quarterly every second month or more frequently fre- quently at the call of the Chair chair if required. The Committee shall maintain minutes of all meetings and make the same available for review. (f) . Any representative appointed or select selected in accordance with (b) hereof shall serve for a term of one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. (ai) The Recognizing its responsibilities under the applicable legislation, the Employer and the Union Association agree that they mutually desire to maintain standards of safety and health in the workplace Lodge in order to prevent accidents, injury and illness. (bii) Recognizing its responsibilities under the applicable legislation, the Employer agrees to accept as a member of its An Accident Prevention – Prevention-Health & and Safety Committee at least three (3) shall be established which is composed of an equal number of Employee and Employer representatives, but with a minimum of one from each base, (1) representative selected or appointed by the Union Association from amongst bargaining unit employees. At any time where a vote is requiredThe representative of the Ontario Nurses’ Association will be certified as per the Occupational Health and Safety Act, an equal number or the Employer will use the funds from the ONA Education Fund as set out in Article 7.07 to pay for the representative to receive the education to become certified as soon as possible after being elected as the ONA representative. The Health and Safety Committee shall hold meetings every second month or more frequently at the call of representatives from each side the chair if required for jointly monitoring, inspecting, investigating and reviewing health and safety conditions and practices. Minutes shall be entitled taken of all meetings and copies shall be sent to votethe Employer and the Association. The responsibility for chairing meetings and for minutes shall be determined by the Committee. (ciii) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs programs, and recommend actions to be taken to improve conditions related to safety and health. (div) The Employee Employer agrees to co-operate reasonably in providing necessary information to enable the Committee to fulfill its functions. (ev) Meetings shall be held quarterly or more frequently at the call All time spent by a member of the Chair if required. The Accident Prevention-Health and Safety Committee shall maintain minutes of all meetings and make the same available for review. Time off for such representative(s) to attend attending meetings of the Accident Prevention – Health & Safety Committee in accordance with the foregoing shall be granted and time so spent attending such meetings carrying out her duties shall be deemed to be work time for which the representative(s) she shall be paid by the her Employer at his her regular or premium rate as may be applicableproper, and she shall be entitled to such time from her work as is necessary. (gvi) The Union representative selected or appointed by the Association shall be entitled to paid leave(s) of absence for education on occupational health and safety, as recommended by the Occupational Health and Safety Committee and approved by the Administrator. vii) Violence in the Workplace A) The parties agree that violence shall be defined as any incident in which a nurse is abused, threatened or assaulted while performing his or her work. The parties agree it includes the application of force, threats with or without weapons and severe verbal abuse. The parties agree that such incidents will not be condoned. Any nurse who believes he/she has been subjected to such incident shall report this to a supervisor who will make every reasonable effort to rectify the situation. B) The Employer agrees to endeavour develop formalized policies and procedures in consultation with the Accident Prevention - Health and Safety Committee to obtain deal with workplace violence. The policy will address the full co-operation prevention of its membership in violence and the observation management of violent situations and support to employees who have faced workplace violence. These policies and procedures shall be communicated to all safety rules and practicesemployees. (hC) Pregnant The Employer will report all incidents of violence as defined herein to the Accident Prevention - Health and Safety Committee for review. D) The Employer agrees to provide training and information on the prevention of violence to all employees may request who come into contact with potentially aggressive persons. This training will be done during a new nurse’s orientation and updated as required. E) Subject to be transferred from their current duties if, in the professional opinion of the employee’s physicianappropriate legislation, the pregnancy Employer will inform the Union within three (3) days of any nurse who has been subjected to violence while performing his/her work. Such information shall be submitted in writing to the Union as soon as practicable. viii) The Joint Health and Safety Committee will discuss and may be at risk. If such a transfer is recommend appropriate measures to promote health and safety in workplaces, including, but not feasible, limited to:  Musculoskeletal Injury Prevention  Needle Stick Injury Prevention  Personal Protective Equipment  competency under the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred to in Article 16.04Act for those persons with supervisory responsibilities.

Accident Prevention Health and Safety Committee. (a) 22.01 The Employer and the Union agree that they mutually desire to maintain standards of safety and health in the workplace home in order to prevent accidents, injury and illness. (b) Recognizing its responsibilities under the applicable legislation, the Employer agrees to accept as a member 22.02 A joint management and employee health and safety committee shall be constituted with representation of its Accident Prevention – Health & Safety Committee at least three (3) representativeshalf by employees from the various bargaining units and of employees who are not represented by Unions and who do not exercise managerial functions, one from each base, selected or appointed by the Union from amongst bargaining unit employees. At any time where a vote is required, an equal number of representatives from each side shall be entitled to vote. (c) Such Committee which shall identify potential dangers and hazardsdangers, institute recommend means of improving the health and safety programs and recommend actions obtaining information from the Employer or other persons respecting the identification of hazards and standards elsewhere. The committee shall normally meet at least once a month. Scheduled time spent in such meetings is to be taken to improve conditions related to safety and health. (d) The Employee agrees to co-operate reasonably in providing necessary information to enable the Committee to fulfill its functions. (e) Meetings considered time worked. Minutes shall be held quarterly or more frequently at the call of the Chair if required. The Committee shall maintain minutes taken of all meetings and make copies shall be sent to the same available for review. (f) Any representative appointed or select in accordance with (b) hereof shall serve a term of Employer and to the Union. The Union agrees to limit representation from the full time and part time bargaining units to one (1) calendar year from the date of appointment joint representative which may be renewed for further periods increased by mutual agreement of the parties. 22.03 Two (2) representatives of the joint Health and Safety Committee, one from management and one (1) year. The Union will encourage its representative(s) to serve at least one (1) year. Time off for such representative(s) to attend meetings from the employees on a rotating basis designated by the employees, shall make monthly inspections of the Accident Prevention – work place and equipment and shall report to the health and safety committee the results of their inspection. In the event of accident or injury, such representatives shall be notified immediately and shall investigate and report as soon as possible to the committee and to the Employer on the nature and causes of the accident or injury. Furthermore, such representatives must be notified of the inspection of a government inspector and shall have the right to accompany him on his inspections. Scheduled time spent in all such activities shall be considered as time worked. 22.04 The Joint Health & and Safety Committee in accordance with and the foregoing representatives thereof shall be granted have reasonable access to the annual summary of data from the Workplace Safety and time so spent attending Insurance Board relating to the number of work accident fatalities, the number of lost workday cases, the number of non-fatal cases that required medical aid without lost workdays, the incidence of occupational injuries, and such meetings shall be deemed other data, as the Workplace Safety and Insurance Board may decide to be work time for which the representative(s) shall be paid by the Employer at his regular or premium rate as may be applicabledisclose. (g) 22.05 The Union agrees to endeavour to obtain the full co-operation of its membership in the observation of all safety rules and practices. (h) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee’s physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred to in Article 16.04

The Committee shall maintain minutes of all meetings and make the same available for review. (f) . (a) The Employer Hospital and the Union agree that they mutually desire to maintain standards of safety and health in the workplace Hospital in order to prevent accidents, injury and illness. (b) Recognizing its responsibilities under the applicable legislation, the Employer Hospital agrees to accept as a member of its Accident Prevention – Health & and Safety Committee at least three one (31) representatives, one from each base, Representative selected or appointed by the Union from amongst bargaining unit Bargaining Unit employees. At any time where a vote is required, an equal number of representatives from each side shall be entitled to vote. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. (d) The Employee Hospital agrees to co-operate reasonably in providing necessary information to enable the Committee to fulfill its functions. (e) Meetings Meeting shall be held quarterly every second month or more frequently at the call of the Chair Chair, if required. . f) The Committee shall maintain minutes of all meetings and make the same available for review. (f. Any Representative(s) Any representative appointed or select selected in accordance with (b) hereof hereof, shall serve for a term of or one (1) calendar year from the date of the appointment which may be renewed for further periods of one (1) year. The Union will encourage its representative(s) to serve at least one (1) year. Time off for such representative(sRepresentative(s) to attend meetings of the Accident Prevention – Health & and Safety Committee in accordance with the foregoing shall be granted and time so spent attending such meetings shall be deemed to be work time for which the representative(sRepresentative(s) shall be paid by the Employer at his his/her regular or premium rate as may be applicable. (g) The Union agrees to endeavour to obtain the full co-operation of its membership in the observation of all safety rules and practices. (h) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee’s physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred to in Article 16.0416.01. i) Where the Hospital identified high risk areas where employees are exposed to Hepatitis B. The Hospital will provide at no cost to the employees, a Hepatitis B Vaccine. j) The employer agrees to undertake if proven the VLF & ELF is required for employee protection that it will be provided. The Occupational Health and Safety Committee will research this and make a recommendation.

Accident Prevention Health and Safety Committee. At any time where a vote is required, an equal number of representatives from each side Such committee shall be entitled to vote. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. (d) . The Employee Hospital agrees to co-operate cooperate reasonably in providing pro- viding necessary information to enable the Committee to fulfill its functions. (e) . Meetings shall be held quarterly or every second more frequently at the call of the Chair chair if required. The Committee shall maintain minutes of all meetings and make the same available for review. (f) . Any representative appointed or select selected in accordance with (b) hereof shall serve for a term of one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. The Union will encourage its representative(s) to serve at least one (1) year. Time off for such representative(s) to attend meetings of the Accident Prevention – Health & and Safety Committee in accordance with the foregoing shall be granted and time so spent attending such meetings shall be deemed to be work time for which the representative(s) shall be paid by the Employer Hospital at his regular or premium rate as may be applicable. (g) . The Union agrees to endeavour to obtain the full co-operation of cooperation its membership in the observation of all safety rules and practices. (h) . Pregnant employees may request to be transferred from their the current duties if, in the professional opinion of the employee’s 's physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant preg- nant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred to in Article 16.04Where the Hospital identifies high risk areas where employees are exposed to Hepatitis the Hospital will provide, at no cost to the employees, a vaccine to Hepatitis B surface Antigen. In addition, the Hospital will provide the committee with reasonable access to all accident reports, health and safety records and any other pertinent information in its possession. (e) Meetings shall be held quarterly every second month or more frequently at the call of the Chair Chair, if required. The Committee shall maintain minutes of all meetings and make the same available for review. (f) Any representative appointed or select selected in accordance with (b) hereof hereof, shall serve for a term of at least one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. The Union will encourage its representative(s) to serve at least one (1) yearappointment. Time off for such representative(s) to attend meetings of the Accident Prevention – — Health & and Safety Committee in accordance with the foregoing foregoing, shall be granted and time so spent any representative(s) attending such meetings during their regularly scheduled hours of work, shall be deemed to be work time for which the representative(s) shall be paid by the Employer at his not lose regular or premium rate earnings as may be applicablea result of such attendance. (g) The Union agrees to endeavour endeavor to obtain the full co-operation cooperation of its membership in the observation of all safety rules and practices. (h) All time spent by a member of the Accident Prevention — Health and Safety Committee attending meetings of the Committee and carrying out her duties, shall be deemed to be work time for which she shall be paid by the Hospital at her regular rate and she shall be entitled to such time from work as is necessary to attend scheduled meetings. (i) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee’s physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred current contractual pregnancy leave. (j) Where the Hospital identifies high risk areas where nurses are exposed to in Article 16.04infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to the nurses.

Accident Prevention Health and Safety Committee. (f) Any representative appointed or select selected in accordance with (b) hereof hereof, shall serve for a term of at least one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. The Union will encourage its representative(s) to serve at least one (1) yearappointment. Recognizing its responsibilities under the applicable legislation, the Employer Corporation agrees to accept as a member of its Accident Prevention – Health & and Safety Committee at least three (3) representatives, one from each base, representative selected or appointed by the Union from amongst bargaining unit employees. At any time where a vote is required, an equal number of representatives from each side shall be entitled to vote. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions condition related to safety and health. (d) . The Employee Corporation agrees to co-operate reasonably in providing pro- viding necessary information to enable the Committee to fulfill its functions. (e) . Meetings shall be held quarterly every second month or more frequently fre- quently at the call of the Chair if required. The Committee shall maintain minutes of all meetings and make the same available for review. (f) . The Hospital agrees t o continue its present practices w i t h respect to the provision of protective clothing and safety devices t o employees, subject t o the provision set out below w i t h respect t o safety footwear. The Hospital further agrees t o meet directly with the representative of the Union or through the Accident Prevention t o discuss the need for any protective clothing or safety equipment in Article 16.04addition t o that which the Hospital is presently providing. Effective September and on that date for each sub- sequent year the Hospital w i l l provide per year t o each full - time employee who is required by the Hospital to wear safety footwear during the course of his duties.

Meetings shall be held quarterly every second month or more frequently at the call of the Chair chair if required. Any representative appointed or select selected in accordance with (b) hereof shall serve for a term of one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. In addition, the Hospital will provide the committee with reasonable access to all accident reports, health and safety records and any other pertinent information in its possession. (e) Meetings shall be held quarterly every second month or more frequently at the call of the Chair Chair, if required. The Committee shall maintain minutes of all meetings and make the same available for review. (f) Any representative appointed or select selected in accordance with (b) hereof hereof, shall serve for a term of at least one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. The Union will encourage its representative(s) to serve at least one (1) yearappointment. Time off for such representative(s) to attend meetings of the Accident Prevention – — Health & and Safety Committee in accordance with the foregoing foregoing, shall be granted and time so spent any representative(s) attending such meetings during their regularly scheduled hours of work, shall be deemed to be work time for which the representative(s) shall be paid by the Employer at his not lose regular or premium rate earnings as may be applicablea result of such attendance. (h) All time spent by a member of the Accident Prevention — Health and Safety Committee attending meetings of the Committee and carrying out her duties, shall be deemed to be work time for which she shall be paid by the Hospital at her regular rate and she shall be entitled to such time from work as is necessary to attend scheduled meetings. (i) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee’s employees physician, the pregnancy may be at risk. , If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred current contractual pregnancy leave. (j) Where the Hospital identifies high risk areas where nurses are exposed to in Article 16.04infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to the nurses.

Accident Prevention Health and Safety Committee. (a) The Employer and the Union agree that they mutually desire to maintain standards of safety and health in the workplace in order to prevent accidents, injury and illness. (b) Recognizing its responsibilities under the applicable legislation, the Employer Health Centre agrees to accept as a member members of its Accident Prevention – - Health & and Safety Committee at least three two (32) representatives, one from each base, representatives selected or appointed by the Union from amongst full-time bargaining unit employees. At any time where a vote is required, an equal number of representatives from each side shall be entitled to vote. (cb) Such Committee committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. (dc) The Employee Health Centre agrees to co-operate cooperate reasonably in providing necessary information to enable the Committee committee to fulfill fulfil its functions. (ed) Meetings shall be held quarterly every second month or more frequently at the call of the Chair chair if required. The Committee shall maintain minutes of all meetings and make the same available for review. (fe) Any representative appointed or select selected in accordance with 22.01 (ba) hereof shall serve for a term of one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. The Union will encourage its representative(s) to serve at least one (1) year. Time off for such representative(s) to attend meetings of the Accident Prevention – - Health & and Safety Committee in accordance with the foregoing shall be granted and time so spent any representative(s) attending such meetings during their regularly scheduled hours of work shall be deemed to be work time for which the representative(s) shall be paid by the Employer at his not lose regular or premium rate earnings as may be applicablea result of such attendance. (i) One Health and Safety Representative to represent all CUPE Bargaining Units will be a certified worker defined under the Occupational Health & Safety Act.

Accident Prevention Health and Safety Committee. (j) Where as a condition of employment, the Employer requires its employees to in Article 16.04receive medication/immunization wherein they may be exposed to infections or communicable diseases, such medications and immunizations shall be provided by the Employer at no cost to the employee.

The following holidays shall be recognized by the Hospital as paid holidays: New Year's Day Labour Day Good Friday Thanksgiving Day Easter Monday Christmas Day Victoria Day Boxing Day Canada Day Floating Holiday August Civic Holiday Remembrance Day The. Floating Holiday may be taken at any time during the twelve (12) consecutive months following the qualifying date on a day mutually agreed upon between the employee and his Department Head. In order to qualify for the holiday an employee must be in the employ of the Hospital on March each year. In the event Heritage Day or some other day is proclaimed as a statutory holiday by the Government of the Province of Ontario for the term of this contract the said day will continue to be a float day.

At any time where a vote is required, an equal number of representatives from each side shall be entitled to vote. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. (d) . The Employee Hospital agrees to co-operate cooperate reasonably in providing necessary information to enable the Committee to fulfill its functions. (e) . In addition, the Hospital will provide the Committee with reasonable access to all accident reports, health and safety records and any other pertinent information in its possession. Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee’s physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the current contractual maternity leave referred leave. Where the Hospital identifies high risk areas where nurses are exposed to infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to the nurses. NOTE: Issues relating to chairing of meetings and responsibility for the taking of minutes should be discussed locally with the Hospital and the other Unions representing employees of the Hospital. The Association may Hospital premises providing permission has been first obtained from the Hospital. The Association shall keep the Hospital notified in Article 16.04writing of the names of the nurse representatives and/or Committee members and Officers of the Local of their respective appointments. All reference to nurse representatives, committee members and officers in this Agreement shall be deemed to mean nurse representatives, committee members or officers of the Local Association. The Hospital give representatives of the Ontario Nurses’ Association access to the premises of the Hospital for the purpose of attending grievance meetings or otherwise assisting in the administration of this Agreement, provided prior arrangements are made with the Administrator. Such representatives shall have access to the premises only with the approval of the Administrator which will not be unreasonably withheld. Where a nurse makes prior arrangements for time off from a tour of duty, the nurse shall not be scheduled to work another tour that day. Nurses who are members of committees pursuant to Regulation of the working hours for attending committee meetings. Where a nurse attends a committee meeting outside of regularly scheduled hours, she will be paid for all hours spent in attendance at meetings at her regular straight time hourly rate.

Accident Prevention Health and Safety Committee. (a) The Employer and the Union agree that they mutually desire to maintain standards of safety and health in the workplace Hospital in order to prevent accidents, injury and illness. (b) . Recognizing its responsibilities under the applicable legislation, the Employer Hospital agrees to accept as a member of its Accident Prevention – Health & and Safety Committee at least three one (31) representatives, one from each base, representative selected or appointed by the Union from amongst bargaining unit employees. At any time where a vote is required, an equal number of representatives from each side shall be entitled to vote. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. (d) . The Employee Hospital agrees to co-operate reasonably in providing necessary information to enable the Committee to fulfill its functions. (e) . Meetings shall be held quarterly every second month or more frequently at the call of the Chair if required. The Committee shall maintain minutes of all meetings and make the same available for review. (f) . Any representative appointed or select selected in accordance with (b) hereof shall serve for a term of one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. The Union will encourage its representative(s) to serve at least one (1) yearIy)ear. Time off for such representative(s) to attend meetings of the Accident Prevention – Health & and Safety Committee in accordance with the foregoing shall be granted and time so spent attending such meetings shall be deemed to be work time for which the representative(s) shall be paid by the Employer Hospital at his regular or premium rate as may be applicable. Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee’s 's physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred to in Article 16.04Where the Hospital identifies high risk areas where employees are exposed to Hepatitis the Hospital will provide, at no cost to the employees, a Hepatitis B vaccine. The Hospital will recognize April as the annual day of remembrance for workers injured or have contracted a work related disease on the job. Subject to the requirements of patient care, the Hospital agrees to stop work and provide a minute of silence for all employees at I A.M. April in memory of workers killed or injured on the job. The announce on its public address system at a.m., April that all employees will be observing a minute of silence in memory of workers killed or injured in the job.

Accident Prevention Health and Safety Committee. (a) 25.01 The Employer and the Union agree that they mutually desire to maintain standards of safety and health in the workplace Employer in order to prevent accidents, injury and illness. (b) Recognizing its responsibilities under 25.02 A joint management and employee Health and Safety Committee shall be constituted with representatives of at least half by employees for the applicable legislationvarious Bargaining Units, and of employees who are not represented by the Unions and who do not exercise managerial functions. The objective of this committee shall be to identify potential dangers, recommend means of improving the health and safety programs, and obtaining information from the Employer agrees to accept as a member of its Accident Prevention – Health & Safety Committee or other persons respecting the identification hazards and standards elsewhere. The committee shall meet at least bi-monthly. An agenda will be presented by the parties no less than three (3) representatives, one from each base, selected or appointed by days prior to the Union from amongst bargaining unit employeesmeeting. At any Scheduled time where a vote spent in such meetings is required, an equal number of representatives from each side to be considered time worked. Minutes shall be entitled to vote. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. (d) The Employee agrees to co-operate reasonably in providing necessary information to enable the Committee to fulfill its functions. (e) Meetings shall be held quarterly or more frequently at the call of the Chair if required. The Committee shall maintain minutes of all meetings and make copies sent to the same available for reviewEmployer and to the Union. (f) Any representative appointed or select in accordance with (b) hereof shall serve a term 25.03 Two representatives of the Joint Health and Safety Committee, one (1) calendar year from management and one from the date of appointment which may be renewed for further periods of one (1) year. The Union will encourage its representative(s) to serve at least one (1) year. Time off for such representative(s) to attend meetings employees on a rotating basis, designated by the employees, shall make monthly inspections of the Accident Prevention – work place and equipment and shall report to the Health & and Safety Committee in accordance with the foregoing results of their inspection. In the event of accident or injury such representatives shall be granted notified immediately and shall investigate and report as soon as possible to the committee and to the Employer on the nature and causes of the accident or injury. Furthermore, such representatives must be notified of the inspection of a government inspector and shall have the right to accompany him on the inspection. Scheduled time so spent attending in all such meetings activities shall be deemed to be work considered as time for which the representative(s) shall be paid by the Employer at his regular or premium rate as may be applicableworked. 25.04 The Joint Health and Safety Committee and the representatives thereof shall have reasonable access to the annual summary of data from the Workplace Safety & Insurance Board (gWSIB) relating to the number of work accident fatalities, the number of non-fatal cases and required medical aid without lost workdays, the incidence of occupational injuries, and such other non-confidential data as the WSIB may decide to disclose. 25.05 The Union agrees to endeavour to obtain the full co-operation cooperation of its membership members in the observation of all safety rules and practices. (h) Pregnant 25.06 The Employer will use its best efforts to make all affected direct case employees aware of residents who have serious infectious diseases. The nature of the disease need not be disclosed. The direct caseworker however, are obligated to maintain confidentiality in respect to this information. Employees who are not direct care employees will be made aware of special procedures required of them to deal with these circumstances. The parties agree that all employees are aware of the requirement to practice universal precautions in all circumstances. 25.07 The Employer shall ensure that all employees are informed that they have the right to refuse work which they reasonably believe may request to endanger them or another worker. This right cannot be transferred from their current duties ifexercised however when the refusal would directly endanger the life, health or safety of another person. Signs will be posted in the professional opinion workplace advising employees of the employee’s physician, the pregnancy may be their right to refuse work. 25.08 Each year on April 28th at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, 11:00 a.m. work will stop and one minute of silence will be granted observed in memory of workers injured or killed on the job. 25.09 In the case of an unpaid outbreak, an employee who has not taken such vaccination or treatment as would enable her to work without presenting a hazard to residents, shall be placed on a leave of absence before commencement and shall be entitled to access any accrued vacation during such leave. An employee who does not take the recommended course of treatment for verified medical or bona fide religious reasons, is entitled to such accommodation as the maternity Employer may direct or, failing that, sick leave referred to in Article 16.04if the credits are available.

Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee’s 's physician, the pregnancy may be at risk. Accident Prevention Health and Safety Committee. (a) The Employer and the Union agree that they mutually desire to maintain standards of safety and health in the workplace Home in order to prevent accidents, injury and illness. (b) Recognizing its responsibilities under the applicable legislation, the Employer agrees to accept as a member of its Accident Prevention – Prevention- Health & and Safety Committee at least three one (31) representatives, one from each base, representative selected or appointed by the Union from amongst bargaining unit employees. At any time where a vote is required, an equal number of representatives from each side shall be entitled to vote. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. (d) The Employee Employer agrees to co-operate cooperate reasonably in providing necessary information to enable the Committee committee to fulfill its functionsfunctions and agrees to make all reasonable efforts to implement the recommendations of the Committee. (e) Meetings shall be held quarterly every third month or more frequently at the call of the Chair Chair, if required. The Committee shall maintain minutes of all meetings and make the same available for review. (f) Any representative appointed or select selected in accordance with (b) hereof hereof, shall serve for a term of at least one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. The Union will encourage its representative(s) to serve at least one (1) year. Time off for such representative(s) to attend meetings of the Accident Prevention – Health & Safety Committee in accordance with the foregoing shall be granted and time so spent attending such meetings shall be deemed to be work time for which the representative(s) shall be paid by the Employer at his regular or premium rate as may be applicableappointment. The Hospital agrees to give representatives of the Ontario Nurses’ Association access to the premises of the Hospital for the purpose of attending grievance meetings or otherwise assisting in the administration of this Agreement, provided prior arrangements are made with the Administrator. Such representatives shall have access to the premises only with the approval of the Administrator which will not be unreasonably withheld. Where a nurse makes prior arrangements for time off from a tour of duty, the nurse shall not be scheduled to work another tour that day. Nurses who are members of committees pursuant to Regulation of the working hours for attending committee meetings. Where a nurse attends a committee meeting outside of regularly scheduled hours, she will be paid for all hours spent in attendance at meetings at her regular straight time hourly rate.

(c) Such Committee committee shall identify potential dangers and hazards, institute means of improving health and healthand safety programs and recommend actions to be taken to improve conditions related to relatedto safety and health. (d) . The Employee Health Centre agrees to co-operate cooperate reasonably in providing necessary information to enable the Committee committee to fulfill fulfil its functions. (e) Meetings . shall be held quarterly every second month or more frequently at the call of the Chair chair if required. Accident Prevention Health and Safety Committee. (a) 27.01 The Employer and the Union agree that they mutually desire to maintain standards of safety and health in the workplace home in order to prevent accidents, injury and illness. (b) Recognizing its responsibilities under the applicable legislation, the Employer agrees to accept as a member 27.02 A joint management and employee health and safety committee shall be constituted with representation of its Accident Prevention – Health & Safety Committee at least three (3) representativeshalf by employees from the various bargaining units and of employees who are not represented by Unions and who do not exercise managerial functions, one from each base, selected or appointed by the Union from amongst bargaining unit employees. At any time where a vote is required, an equal number of representatives from each side shall be entitled to vote. (c) Such Committee which shall identify potential dangers and hazardsdangers, institute recommend means of improving the health and safety programs and recommend actions obtaining information from the Employer or other persons respecting the identification of hazards and standards elsewhere. The committee shall normally meet at least once a month. Scheduled time spent in such meetings is to be taken to improve conditions related to safety and health. (d) The Employee agrees to co-operate reasonably in providing necessary information to enable the Committee to fulfill its functions. (e) Meetings considered time worked. Minutes shall be held quarterly or more frequently at the call of the Chair if required. The Committee shall maintain minutes taken of all meetings and make copies shall be sent to the same available for review. (f) Any representative appointed or select in accordance with (b) hereof shall serve a term of Employer and to the Union. The Union agrees to limit representation from the full time and part time bargaining units to one (1) calendar year from the date of appointment joint representative which may be renewed for further periods increased by mutual agreement of the parties. 27.03 Two (2) representatives of the joint Health and Safety Committee, one from management and one (1) year. The Union will encourage its representative(s) to serve at least one (1) year. Time off for such representative(s) to attend meetings from the employees on a rotating basis designated by the employees, shall make monthly inspections of the Accident Prevention – work place and equipment and shall report to the Health & and Safety Committee in accordance with the foregoing results of their inspection. In the event of accident or injury, such representatives shall be granted notified immediately and shall investigate and report as soon as possible to the committee and to the Employer on the nature and causes of the accident or injury. Furthermore, such representatives must be notified of the inspection of a government inspector and shall have the right to accompany him on his inspections. Scheduled time so spent attending in all such meetings activities shall be deemed to be work considered as time for which the representative(s) shall be paid by the Employer at his regular or premium rate as may be applicableworked. (g) 27.04 The Joint Health and Safety Committee and the representatives thereof shall have reasonable access to the annual summary of data from the Workplace Safety and Insurance Board relating to the number of work accident fatalities, the number of lost workday cases, the number of non-fatal cases that required medical aid without lost workdays, the incidence of occupational injuries, and such other data, as the Workplace Safety and Insurance Board may decide to disclose. 27.05 The Union agrees to endeavour to obtain the full co-operation of its membership in the observation of all safety rules and practices. (h) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee’s physician, the pregnancy may be at risk.
