Accident Prevention Health and Safety Committee. (a) The Employer and the Union agree that they mutually desire to maintain standards of safety and health in the workplace in order to prevent accidents, injury and illness. (b) Recognizing its responsibilities under the applicable legislation, the Employer agrees to accept as a member of its Accident Prevention – Health & Safety Committee at least three (3) representatives, one from each base, selected or appointed by the Union from amongst bargaining unit employees. At any time where a vote is required, an equal number of representatives from each side shall be entitled to vote. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. The Union will encourage its representative(s) to serve at least one (1) year. Time off for such representative(s) to attend meetings of the Accident Prevention – Health & Safety Committee in accordance with the foregoing shall be granted and time so spent attending such meetings shall be deemed to be work time for which the representative(s) shall be paid by the Employer at his regular or premium rate as may be applicable. (g) The Union agrees to endeavour to obtain the full co-operation of its membership in the observation of all safety rules and practices. (h) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee’s physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred to in Article 16.04

(h) All time spent by a member of the Accident Prevention Health and Safety Committee attending meetings of the Committee and carrying out her duties, shall be deemed to be work time for which she shall be paid by the Hospital at her regular rate and she shall be entitled to such time from work as is necessary to attend scheduled meetings. i) Pregnant employees may request to be transferred from their current duties ifduties, if in the professional opinion of the employee’s 's physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred current contractual pregnancy leave. j) Where the Hospital identifies high-risk areas where Employees are exposed to in Article 16.04infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to the employees.

The Company will announce on its public address system at 11:00 a.m., April 28 that all employees will be observing a minute of silence in memory of workers killed or injured in the job.

Scheduled time so spent attending in all such meetings activities shall be deemed to be work considered as time for which the representative(s) shall be paid by the Employer at his regular or premium rate as may be applicableworked. 25.04 The Joint Health and Safety Committee and the representatives thereof shall have reasonable access to the annual summary of data from the Workplace Safety & Insurance Board (gWSIB) relating to the number of work accident fatalities, the number of non-fatal cases and required medical aid without lost workdays, the incidence of occupational injuries, and such other non-confidential data as the WSIB may decide to disclose. 25.05 The Union agrees to endeavour to obtain the full co-operation cooperation of its membership members in the observation of all safety rules and practices. (h) Pregnant 25.06 The Employer will use its best efforts to make all affected direct case employees aware of residents who have serious infectious diseases. The nature of the disease need not be disclosed. The direct caseworkers however, are obligated to maintain confidentiality in respect to this information. Employees who are not direct care employees will be made aware of special procedures required of them to deal with these circumstances. The parties agree that all employees are aware of the requirement to practice universal precautions in all circumstances. 25.07 The Employer shall ensure that all employees are informed that they have the right to refuse work that they reasonably believe may request to endanger them or another worker. This right cannot be transferred from their current duties ifexercised however when the refusal would directly endanger the life, health or safety of another person. Signs will be posted in the professional opinion workplace advising employees of the employee’s physician, the pregnancy may be their right to refuse work. 25.08 Each year on April 28th at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, 1100 hours work will stop and one (1) minute of silence will be granted observed in memory of workers injured or killed on the job. 25.09 In the case of an unpaid leave outbreak an employee who has not taken such vaccination or treatment as would enable her to work without presenting a hazard to residents, shall be placed on a level of absence before commencement and shall be entitled to access any accrued vacation during such leave. An employee who does not take the recommended course of treatment for verified medical or bona fide religious reasons is entitled to such accommodation as the maternity Employer may direct or, failing that, sick leave referred to in Article 16.04if the credits are available.

The Hospital further agrees to meet directly with the representative of the Union or through the Accident Prevention Committee to discuss the need for any protective clothing or safety equipment in addition to that which the Hospital is presently providing. Effective date of ratification and on that date for each subsequent year, the Hospital will provide thirty-five dollars ($35.00) per year to each full-time employee who is required by the Hospital to wear safety footwear during the course of his duties.

Any nurse who believes he/she has been subjected to such incident shall report this to a supervisor who will make every reasonable effort to rectify the situation. B) The Employer agrees to endeavour develop formalized policies and procedures in consultation with the Accident Prevention - Health and Safety Committee to obtain deal with workplace violence. The policy will address the full co-operation prevention of its membership in violence and the observation management of violent situations and support to employees who have faced workplace violence. These policies and procedures shall be communicated to all safety rules and practicesemployees. (hC) Pregnant The Employer will report all incidents of violence as defined herein to the Accident Prevention - Health and Safety Committee for review. D) The Employer agrees to provide training and information on the prevention of violence to all employees may request who come into contact with potentially aggressive persons. This training will be done during a new nurse’s orientation and updated as required. E) Subject to be transferred from their current duties if, in the professional opinion of the employee’s physicianappropriate legislation, the pregnancy Employer will inform the Union within three (3) days of any nurse who has been subjected to violence while performing his/her work. Such information shall be submitted in writing to the Union as soon as practicable. viii) The Joint Health and Safety Committee will discuss and may be at risk. In the event Heritage Day or some other day is proclaimed as a statutory holiday by the Government of the Province of Ontario for the term of this contract the said day will continue to be a float day.

(b) Recognizing illness its responsibilities under the applicable legislation, the Employer Hospital agrees to accept as a member of its Accident Prevention – Health & Safety Committee at least three (3) representatives, one from each base, selected or appointed -Health by the Union Association from amongst bargaining unit employees. At any time where a vote is required, an equal number of representatives from each side shall be entitled to vote. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. (d) . The Employee Hospital agrees to co-operate cooperate reasonably in providing necessary information to enable the Committee to fulfill its functions. (e) . In addition, the Hospital will provide the Committee with reasonable access to all accident reports, health and safety records and any other pertinent information in its possession. Meetings shall be held quarterly every second month or more frequently at the call of the Chair Chair, if required. The Committee shall maintain minutes of all meetings and make the same available for review. (f) . Any representative appointed or select selected in accordance with (b) hereof hereof, shall serve for a term of at least one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee’s physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the current contractual maternity leave referred leave. Where the Hospital identifies high risk areas where nurses are exposed to infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to the nurses. NOTE: Issues relating to chairing of meetings and responsibility for the taking of minutes should be discussed locally with the Hospital and the other Unions representing employees of the Hospital. The Association may Hospital premises providing permission has been first obtained from the Hospital. The Association shall keep the Hospital notified in Article 16.04writing of the names of the nurse representatives and/or Committee members and Officers of the Local of their respective appointments. All reference to nurse representatives, committee members and officers in this Agreement shall be deemed to mean nurse representatives, committee members or officers of the Local Association. The Hospital give representatives of the Ontario Nurses’ Association access to the premises of the Hospital for the purpose of attending grievance meetings or otherwise assisting in the administration of this Agreement, provided prior arrangements are made with the Administrator. Such representatives shall have access to the premises only with the approval of the Administrator which will not be unreasonably withheld. Where a nurse makes prior arrangements for time off from a tour of duty, the nurse shall not be scheduled to work another tour that day. Nurses who are members of committees pursuant to Regulation of the working hours for attending committee meetings. Where a nurse attends a committee meeting outside of regularly scheduled hours, she will be paid for all hours spent in attendance at meetings at her regular straight time hourly rate.

Accident Prevention Health and Safety Committee. (h) Pregnant 25.06 The Employer will use its best efforts to make all affected direct case employees aware of residents who have serious infectious diseases. The nature of the disease need not be disclosed. The direct caseworker however, are obligated to maintain confidentiality in respect to this information. Employees who are not direct care employees will be made aware of special procedures required of them to deal with these circumstances. The parties agree that all employees are aware of the requirement to practice universal precautions in all circumstances. 25.07 The Employer shall ensure that all employees are informed that they have the right to refuse work which they reasonably believe may request to endanger them or another worker. This right cannot be transferred from their current duties ifexercised however when the refusal would directly endanger the life, health or safety of another person. Signs will be posted in the professional opinion workplace advising employees of the employee’s physician, the pregnancy may be their right to refuse work. 25.08 Each year on April 28th at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, 11:00 a.m. work will stop and one minute of silence will be granted observed in memory of workers injured or killed on the job. 25.09 In the case of an unpaid outbreak, an employee who has not taken such vaccination or treatment as would enable her to work without presenting a hazard to residents, shall be placed on a leave of absence before commencement and shall be entitled to access any accrued vacation during such leave. An employee who does not take the recommended course of treatment for verified medical or bona fide religious reasons, is entitled to such accommodation as the maternity Employer may direct or, failing that, sick leave referred to in Article 16.04if the credits are available.

Accident Prevention Health and Safety Committee. (g) 27.04 The Joint Health and Safety Committee and the representatives thereof shall have reasonable access to the annual summary of data from the Workplace Safety and Insurance Board relating to the number of work accident fatalities, the number of lost workday cases, the number of non-fatal cases that required medical aid without lost workdays, the incidence of occupational injuries, and such other data, as the Workplace Safety and Insurance Board may decide to disclose. 27.05 The Union agrees to endeavour to obtain the full co-operation of its membership in the observation of all safety rules and practices.
