Accidental Loss Clause Samples
The Accidental Loss clause defines how responsibility for loss or damage to goods or property is allocated when such loss occurs unintentionally during the course of a contract. Typically, this clause specifies the point at which risk transfers from one party to another, such as upon delivery or acceptance of goods, and may outline exceptions or procedures in the event of accidental damage. Its core function is to clarify which party bears the risk of unforeseen loss, thereby reducing disputes and ensuring both parties understand their obligations and liabilities.
Accidental Loss. If your device is accidentally lost then we will replace it with an excess fee.
Accidental Loss. An excess of NZ$500 (inclusive of GST) will apply to each individual consignment, unless otherwise stated in the Schedule. The excess is to be borne by the Insured and will remain uninsured.
Accidental Loss. A permanent and involuntary failure to keep possession of property. For the avoidance of doubt, Accidental Loss does not include instances when You sell or give away the Covered Handset.
Accidental Loss. Company will replace covered Gadget if the covered accidentally lost it, meaning that you have accidentally left the Gadget in a location and you are permanently deprived of its use. Where only part or parts of the gadget have been lost, Company will only replace that part or parts.
Accidental Loss with reference to life: death; • with reference to an eye: the total and irrecoverable loss of sight; • with reference to hands and feet: the complete amputation at the wrist or ankle joint, or above; • with reference to arms and legs: the complete amputation at the elbow or knee joint, or above; • with reference to hearing: the total and irrecoverable loss of the ability to hear with both ears; • with reference to speech, the total and irrecoverable loss of the ability to utter intelligible sounds; • with reference to one finger: complete amputation at distal phalange, or above; • with reference to one toe: complete amputation of two phalanges.
Accidental Loss. (a) If, in the judgment of the Party possessing an item subject to limitations provided for in the Treaty, that item is lost as a result of an accident, notification thereof shall be provided in accordance with paragraph 3 of Section I of the Notification Protocol.
(b) The item shall cease to be subject to the limitations provided for in the Treaty as of the date or assumed date of the accidental loss specified in such a notification.
Accidental Loss. This policy covers Accidental Loss to Insured Property occurring during Transit caused by an external and physical event.
