(a) Customer acknowledges that from and including October 10, 1995 Customer's Outstanding Advances have exceeded Customer's Borrowing Base and that, as of the close of business on December 12, 1995, Outstanding Advances exceeded the Borrowing Base in the approximate amount of $26,265,485.
