Acknowledgement by Customer. The Customer acknowledges the Scheme Owner may, from time to time, add chemicals to water in the Distribution Network for overall maintenance purposes including weed control and that such chemicals will affect water quality.

Customer acknowledges and agrees that ReliaQuest is only being engaged to help identify such threats and expressly agrees that ReliaQuest shall not be responsible under any circumstances in the event any such issues occur. Unless as otherwise agreed in writing, in no event will Customer provide access to or transmit to ReliaQuest (via Log Data or otherwise) any personally identifiable information, protected health information, or other personal information that is subject to data privacy or security laws or regulations.
Acknowledgement by Customer. The Customer acknowledges that Western Union has entered into this Agreement and will enter into the transactions contemplated by this Agreement in reliance on the representations and warranties in Section 2 above.

(a) Customer acknowledges that from and including October 10, 1995 Customer's Outstanding Advances have exceeded Customer's Borrowing Base and that, as of the close of business on December 12, 1995, Outstanding Advances exceeded the Borrowing Base in the approximate amount of $26,265,485. Customer acknowledges that, as a result thereof, Customer is in default to IBM Credit under the terms of the Agreement in that Customer has failed to repay the Outstanding Advances in an amount equal to the Shortfall Amount.
