Acquittal. Unless earlier terminated, this Agreement will terminate at the time of Acquittal.
Acquittal. The Project will be acquitted once:
(a) the final invoice from the Nominated Installer is provided by the Recipient in accordance with clause 4(b); and
(b) the Department accepts the independent inspector’s report provided by the Recipient in accordance with clause 5.
Acquittal. 18.1 Subject to full compliance by: the Company and the ModusLink Group with the above, the Employee declares that the Company and the ModusLink Group and all their parent(s), subsidiaries or other affiliated companies (including, but not limited to ModusLink Corporation and CMGI, Inc. and all companies listed in Enclosure 1 of this agreement) have fulfilled all their obligations resulting from the Employment Agreement or any agreement related to his employment, and the Employee hereby acquits the Company and the ModusLink Group of all their possible past, existing or future obligations resulting from any and all claims, charges, complaints, demands, actions, causes of action, suits, rights, debts, sums of money, costs, accounts, reckonings, covenants, contracts, agreements, promises, doings, omissions, damages, executions, obligations, liabilities, and expenses (including attorneys’ fees and costs), of every kind and nature which the Employee ever had or now have against any of the above companies, including but not limited to, all claims arising out of the Employee’s employment with and/or separation from the Company and/or any company of the ModusLink Group, from any other work or services performed and waives all related rights or claims other than those specifically mentioned in this agreement.
18.2 Parties explicitly agree that the amounts mentioned in this agreement shall be granted to the Employee on the condition that the Company and the ModusLink Group and or their parent(s), subsidiaries or other affiliated companies (including, but not limited to ModusLink corporation and CMGI, Inc.) shall not have any obligations other than those mentioned in this agreement.
18.3 Subject to full compliance by the Employee with this agreement, the Company and the ModusLink Group declare to acquit the Employee from any obligations resulting from any and all claims, charges, complaints, demands, actions, causes of action, suits, rights, debts, sums of money, costs, accounts, reckonings, covenants, contracts, agreements, promises, doings, omissions, damages, executions, obligations, liabilities, and expenses (including attorneys’ fees and costs), of every kind and nature which the Company and the ModusLink Group ever had or now have against the Employee, including but not limited to, all claims arising out of his employment with and/or separation from the Company and/or any company of the ModusLink Group, from any other work or services performed, and waives all r...
Acquittal. (a) Unless earlier terminated, this Agreement will terminate upon submission and acceptance of the Acquittal Report.
(b) Should the Grantee be unable to properly use the Grant Funds in accordance with this Agreement, the Grantee will advise the Grantor as immediately as it becomes aware of this and the Grantor may require that any unused portion of Grant Funds be returned within forty (40) Business Days.
Acquittal. The Grantee is to provide to the State a report (the Acquittal) at the completion of the Project or the conclusion of this Agreement (whichever occurs first), which shall include:
(i) a financial report (certified by the Chief Financial Officer or Accountable Officer of the Grantee and audited by an Auditor) certifying that the Grant was used for the Project and confirming the amount spent; such certification to address the issues itemised in this Schedule; and
(ii) a project report as per this Schedule, showing how and to what extent the Grant was spent and the extent to which the Milestones and outcomes were achieved. Note – the Acquittal is to be submitted within three (3) months after the completion of the Project.
Acquittal. (1) The Administrator may not revoke, and the Board may not affirm a rev- ocation of, a certificate of registration under this section on the basis of an activity described in subsection (b)(1)(A) of this section if the hold- er of the certificate is acquitted of all charges related to a controlled substance in an indict- ment or information arising from the activity.
(2) If the Administrator has revoked a certifi- cate of registration of a person under this sec- tion because of an activity described in sub- section (b)(1)(A) of this section, the Adminis- trator shall reissue a certificate to the person if the person—
(A) subsequently is acquitted of all charges related to a controlled substance in an indict- ment or information arising from the activity; and
(B) otherwise meets the requirements of sec- tion 44102 of this title. (Pub. L. 103–272, § 1(e), July 5, 1994, 108 Stat.
Acquittal. (1) The Administrator may not revoke, and the Board may not affirm a rev- ocation of, an airman certificate under sub- section (b)(2) of this section on the basis of an activity described in subsection (b)(2)(A) if the holder of the certificate is acquitted of all charges related to a controlled substance in an indictment or information arising from the ac- tivity.
(2) If the Administrator has revoked an air- man certificate under this section because of an activity described in subsection (b)(2)(A) of this section, the Administrator shall reissue a cer- tificate to the individual if—
(A) the individual otherwise satisfies the re- quirements for a certificate under section 44703 of this title; and
(B) (i) the individual subsequently is acquit- xxx of all charges related to a controlled sub- stance in an indictment or information arising from the activity; or
Acquittal. Acquittal of each financial year’s Grant Funds is required at the end of the respective financial year in accordance with Schedule 2. This arrangement will be in place for the entire Agreement period. Where applicable, payment of the Grant Funds is dependent on the successful acquittal of the previous year’s grant. Acquittal of the final financial year’s Grant Fund will signal termination by performance of the Agreement.
Acquittal. 12.1 The failure of one Party in implementing one of or several liabilities based on this Agreement, does not discontinue the other Party from continuing to implement this Agreement and the Party which can not perform such liabilities will still have to strive for the implementation of its liabilities and bear the costs inflicted by such a failure.
12.2 The absence of claim by one Party in relation to the violation against a provision in the Agreement, committed by the other Party, does not represent acquittal from implementing the provision.
