Acting Capacity Pay. (1) An appointing authority may designate an employee to perform temporary duties in a classification for which the rate of pay is higher than that of the employee's classification for any of the following reasons: a.) The temporary absence of an incumbent; b.) A vacancy exists for which recruitment is underway; or c.) Unusual circumstances which necessitate assignment of duties at a level higher than that of the employee's classification. d.) A qualified employee with the most seniority in the unit where the acting capacity is to occur will normally be given the opportunity to perform the higher level duties. If a less senior employee is designated, upon written request from the Union, the appointing authority or designee shall provide a copy of the acting capacity form as documentation of the selection. e.) Should a supervisor assign an employee more than 50% of the higher-level duties of a position that is vacant or from which the incumbent is temporarily absent, the employee shall be considered designated for acting capacity pay. (2) Wherever possible an appointing authority shall ensure that an employee designated to receive acting capacity pay meets the minimum qualifications of the higher level and upon written request from the Union shall provide a copy of the acting capacity form as documentation of the selection. (3) An appointing authority may not designate an employee to perform temporary duties in a classification for which the rate of pay is higher than that of the employee's classification if both the employee's classification and the higher classification are within the same noncompetitive promotion classification series. (4) Payment for acting in a higher classification shall be made as follows when the employee's normal rate of compensation is: a.) Between grades 5 and 10, additional compensation shall be paid for the period in excess of 10 continuous workdays; b.) For grade 11 or above, additional compensation shall be paid for the period in excess of 20 continuous workdays. The initial period of acting capacity is limited to 6 months or less and may be extended for periods of up to 6 months. Notwithstanding the above, hour-for-hour acting capacity pay shall be paid to eligible employees who function in the capacity of the Transportation Heavy Equipment Shop Chief effective with the first hour of the assignment and acting capacity pay will continue to be paid in other cases where employees currently receive such pay. Acting Capacity Pay. An employee assigned to perform the duties associated with a classification with a higher rate of pay than that of the employee’s classification shall receive the hourly rate applicable to the higher classification. This higher rate of pay is Acting Capacity Pay. Prior to accepting the acting capacity appointment, the employee will be notified in writing of the duties expected. Acting Capacity Pay shall be paid for the period in excess of five (5) continuous work days. The initial period of Acting Capacity Pay shall be limited to six (6) months or less and may be extended for period up to six (6) months. The performance evaluation of the employee working the duties of a higher pay rate shall reflect the added responsibilities the employee performs. An employee in Acting Capacity shall not be relieved of such capacity prior to the completion of the five-day waiting period for the purpose avoiding Acting Capacity Pay. The College shall not rotate employees in an acting capacity position to avoid acting capacity pay, nor shall employees be recurrently scheduled in an acting capacity position without compensation. An employee shall not be required to accept an acting capacity assignment if he/she would suffer a loss in pay. Acting Capacity appointments are voluntary. No employee shall be disciplined or retaliated against for rejecting an opportunity to work in an acting capacity appointment. Employees who do not satisfactorily perform the required elements of the higher classification shall be returned to their position instead of suffering formal disciplinary action.
Acting Capacity Pay. When employees are placed in a Temporary Assignment or an Acting Appointment, duration, salary adjustments, if any, and other terms and conditions regarding the Assignment or Appointment shall be treated by the University consistent with USM Policy VII-9.50 Policy on Temporary Assignments and Acting Appointments applicable to Nonexempt employees, and USM Policy and Procedures VII – 9.11 (A)(2)(C) except as modified below, (A) In the event of a Temporary Assignment, when assigning additional duties to an employee, the supervisor will identify the employee’s work priorities and make adjustments to work assignments as necessary. (B) Temporary Assignments and Acting Appointments normally shall not be made for more than twelve (12) months. However, where operationally necessary, Acting Appointments may be extended for up to an additional twelve (12) months.
Acting Capacity Pay. A. Acting capacity pay is paid when an officer is appointed to a different position in a higher sworn police officer classification on a temporary basis. An officer who is in acting capacity must meet the minimum qualifications of the position. The effective date for acting capacity pay shall be the date that the officer began performing the higher level duties consistent with Section 1. B. The amount of acting capacity pay shall be the amount which the officer would be paid if reclassified to the higher classification. C. When an officer is appointed to acting capacity to a classification with a salary range which is one (1) pay range higher, the officer shall be given at least a six percent (6%) increase in annual salary. When an officer is appointed to a classification with a salary range which is two (2) or more pay ranges higher, the officer shall be given at least a twelve percent (12%) increase in annual salary. D. At the conclusion of the Acting Capacity Appointment, the officer shall be returned to the officer’s former position with the same salary and status which the officer held prior to the acting capacity appointment. Additional salary adjustments will be made if there were any pay adjustments such as merit or COLA that occurred during the acting appointment.
Acting Capacity Pay. An employee who is required to perform in a position that is a higher level position in the bargaining unit than that of the employee’s current position shall be paid additional compensation after twenty-two (22) consecutive work days from the first day the employee started working in the higher level position. The amount of acting capacity pay shall be 6% higher than the employee’s current salary. Acting capacity shall be paid on an hour for hour basis. The original period of acting capacity shall be no more than six (6) months. For operational reasons, the employee may be assigned to an additional six (6) months extension. Acting capacity may not exceed twelve (12) months.

An employee who is in acting capacity must meet the minimum qualifications of the position. The amount of acting capacity pay shall be the amount which the employee would be paid if reclassified to the higher classification as outlined in Article 32 Job Classification and Reclassification.

Acting Capacity Pay. When employees are placed in a Temporary Assignment or an Acting Appointment, duration, salary adjustments if any, and other terms and conditions regarding the Assignment or Appointment shall be controlled by USM Policy VII-9.50 concerning Temporary Assignments and Acting Appointments. However, where the employee is in an Acting Appointment which is considered to be in a Pay Range which is two (2) or more Pay Ranges higher than the Pay Range of the employee’s normal appointment, the employee will receive a twelve percent (12%) increase (or the minimum of the pay range, whichever is higher) for the period of the Acting Capacity assignment, subject to all the other provisions of USM Policy VII-9.50.

When an employee is appointed to a higher level position on a temporary basis, the employee is in acting capacity and shall be eligible for acting capacity pay beginning on the 31st consecutive calendar day of work in the acting capacity, retroactive to the first day that the employee served in the acting capacity. B. The employee is eligible for a salary increase of not less than six percent (6%). Upon conclusion of the acting appointment, the employee’s salary reverts to the employee’s last regular salary rate in effect prior to the acting appointment, subject to adjustment for any intervening salary adjustments, other than acting capacity pay, that have occurred. An employee who is in acting appointment status must meet the minimum qualifications of the position to which he or she is appointed.
