ACTING OFFICERS. A. Temporary employee assignments on an acting pay basis to the ranks of Paramedic Supervisor, Paramedic Coordinator, Lieutenant, Captain or Deputy Chief shall be compensated at the appropriate rate of the higher class providing the assignment is for a period of not less than four (4) hours. A Fire Lieutenant may be assigned to fill the role of Paramedic Supervisor without eligibility for acting pay. D. Members assigned on an acting basis in the rank of Paramedic Supervisor, Lieutenant, Captain, or Deputy Chief will be paid in the first step of the rank in which they are acting. E. The Chief of the Division of Fire shall have the right to determine the need for filling of vacant positions on an acting basis except as otherwise modified by the above provisions. F. The Division of Fire shall maintain a list of members eligible to work as acting officers. It shall be voluntary to be placed on this list. Those on the list must have at least four (4) years on the Xxxxxxxx Fire Department. In the event that no acting officers are available (on duty) from the list, the Deputy Chief shall make assignments as he deems necessary. In the event that there are no qualified Firefighters who are scheduled to work in such Fire Company/Fire Station on such day or if all such qualified Firefighters in such Fire Company/Fire Station refuse to accept such offer to serve as an Acting Officer such assignment will be offered in order of seniority to all qualified Firefighters in the other Fire Companies who are scheduled to work that day. In the event that such acting officers are available (on duty) from assignment is not filled by either of the listforegoing procedures, the Deputy Officer in charge of the group shall order the first Firefighter who had been offered the assignment, to fill such Acting Officer assignment. The Acting Captain assignment in each Fire Company shall be given to the Lieutenant in such Fire Company with the most seniority who is qualified in the judgment of the Fire Chief to serve as an Acting Captain. 1490 Section 3. The Acting Assistant Chief assignment shall be given to the Fire Captain with the most seniority in such rank who is scheduled to work on the day such Assistant Chief is absent. With regard to Acting Assistant Chief assignments only, the provisions of Section 1 of this Article shall not apply. Bargaining unit members holding the rank of Fire Captain shall not have the right to refuse an Acting Assistant Chief Assignment unless no other Captain accepts the assignment. If the Fire Chief makes a judgment that an employee is not qualified to serve in an acting capacity in a certain classification, the employee adversely affected by this judgment may grieve this decision in accordance with the provisions of Article V of this contract, except, should an individual be denied the right to serve in an acting capacity because of his/her failure to pass the most recent promotional examination for the rank involved, he/she shall not have the right to grieve this decision. 1500 Section 4. The provisions of Section 2 of this Article notwithstanding, no employee shall be offered an assignment to serve in an acting capacity in a higher classification than his/her regular classification unless he/she signs a roster, prescribed by the Fire Chief, affirming his/her desire to be offered such assignments. Each such roster shall remain in effect until the employee indicates to the Chief in writing of a change in status. Status cannot be changed more than once every twelve (12) months. Employees who sign the roster indicating they do not desire to be offered an acting assignment shall not be offered an assignment. Employees indicating that they will accept an acting assignment cannot refuse any assignments offered department-wide if such acceptance has been indicated on said roster. The Fire Chief shall make assignments as he deems necessarycertain that each employee is given the opportunity to sign the first roster and each roster established thereafter in accordance with this Section. This provision shall not create overtimeFor an employee who is hired on or after July 1, it only specifies that members from 2002, the acting officers employee must be on the current promotional list shall be used before going outside (or most recent list, in the list to make assignmentsabsence of a current list).

There is no right of refusal for the least senior employee. (a) In two or three engine company houses, when the Captain assigned to the engine house is absent, the senior Lieutenant assigned to that house on that shift shall serve as Acting Captain. (b) In single engine company houses, when the Captain assigned to the engine house is absent, the senior Lieutenant assigned to that house shall serve as Acting Captain. (c) When the senior Lieutenant in 11.4(a) and (b) above is absent for vacation, injury leave, sick leave, special leave or leave without pay, the next senior Lieutenant will be paid in the first step of the rank in which they are actingassigned. Acting Drill Master In the event of an anticipated extended absence of the Drill Master, the Deputy Chief following policy for Acting Drill Master will be enacted to ensure continuity of necessary training: A notice will be posted in all BFD fire stations announcing the vacancy in the Training Division, and the estimated duration of the vacancy. The notice will include a request for names of those wishing to fill the vacancy on a temporary transfer basis, and the method in which to submit those names. A cutoff date for requests will be included. Qualified applicants will be certified as FSI-I, and meet the current requirements necessary to promote to the rank of Drill Master as outlined in the current CBA, Article XXXVI Promotion Process - General, Section 36:1. If multiple applications are submitted by qualified applicants, the choice of Acting Drill Master will be made on the basis of seniority. If no applications are submitted by qualified applicants, the parties shall make assignments meet to discuss how to accomplish necessary training. The work schedule will be as he deems necessarydescribed for Drill Master in the current CBA, Article X, Work Week, Section 10:2. This provision shall not create overtimeThe pay grade will be that of Drill Master, it only specifies Step 3 as outlined in the current Salary Schedule of the CBA in place at the time the Acting Drill Master position is being worked. If the vacancy lasts longer than expected, the person in the Acting Drill Master position will be given the option of remaining in that members from position, or opting to return to his/her previous position, providing that there is a suitable substitute willing to fill the acting officers list position. The Acting Drill Master will continue to have the ability to work overtime as a Fire Officer as is the current practice. He/she shall be compensated at time and one-half of the salary being received in the positon of Acting Drill Xxxxxx. The conversion of time earned and used before going outside (vacation, sick, EPL) shall be done in adherence with the list MOU between the City of Bristol and Local #773 IAFF, executed on January 18, 2011. If the Acting Drill Master is absent due to make assignmentsuse of vacation, EPL, or short-term sick use, the position will not be back filled. If a person working in the positon of Acting Drill Xxxxxx decides to retire while working in that position, he/she shall be retired at the previous rank/step held, and all retirement calculations will use the factors relative to the previous position held when determining retirement benefits and payout. If at any time during his/her absence the incumbent Drill Master opts to retire, a competitive promotional exam will be administered as outlined in Article XXXVI, Promotional Process – General, in the current CBA. 12:2 No employee may work in an acting capacity at a higher classification unless he/she has been employed for at least five (5) years.

ACTING OFFICERS. A. Temporary Section 1. Provisional appointments to fill permanent vacancies shall be made by the Mayor, provided no eligibility lists exist for such classification. Provisional appointments shall only exist until such time as a permanent appointment has been made, but in no event shall such appointment exceed one hundred eighty (180) days in duration. Section 2. Whenever a Fire Lieutenant is absent from duty on a temporary vacancy from a fire fighting company in a fire station, and his position is not covered by overtime work, the senior Firefighter regularly assigned to and on duty in such fire station during such absence, who is on the current Lieutenant's eligibility list for the promotion to Fire Lieutenant, or if there is not a current list, the last expired list, shall have first option to serve as the Acting Fire Lieutenant. In the event there is no such employee assignments on duty, the senior firefighter on the Platoon who is on duty and is on the current or last expired eligibility list for promotion to Fire Lieutenant shall have the first option to serve as the Acting Fire Lieutenant. In the event there is no such employee on duty, a Lieutenant shall be hired to fill such vacancy and in the event a Lieutenant is not available for such overtime, the junior Lieutenant shall be ordered to fill said vacancy. Whenever a Dispatcher is absent from duty on a temporary vacancy, and his position is not covered by overtime work, the senior Firefighter regularly assigned to and on duty in Fire Headquarters during such absence, who is qualified to serve as an acting pay basis Acting Dispatcher, shall have the first option to be the Acting Dispatcher covering such absence, and he shall be paid the first step of the Dispatcher's salary range for each tour of duty or majority portion thereof during which he performs such Acting Dispatcher's services. Whenever a Fire Captain is absent from duty on a temporary vacancy from a fire fighting company, and his position is not covered by overtime work, the Senior Lieutenant regularly assigned to the ranks same platoon as such Captain shall have the first option to be the Acting Captain covering such absence, except, if such Senior Lieutenant is also absent from duty, the next Senior Lieutenant who is regularly assigned to the same platoon as such Captain shall have the first option to be the Acting Captain covering such absence. Whenever a Deputy Chief is absent from duty on a temporary basis from a fire fighting platoon and his position is not covered by overtime with the same rank, the Captain on duty shall have the first option to assume the duties of Paramedic Supervisora Deputy Chief during that period. If a Captain is hired for overtime and a Deputy Chief's position is open, Paramedic Coordinatorthe Captain hired on the overtime basis shall be designated the Deputy Chief. If all Lieutenants on duty refuse to serve as an Acting Captain, Lieutenantthe senior Lieutenant on duty shall be ordered to serve as an Acting Captain covering such absence. Whenever any such Fire Lieutenant shall serve as an Acting Captain for each tour of duty or majority portion thereof during which he serves in such capacity, he shall receive the first step of the Fire Captain's salary range. Whenever a Deputy Chief is absent from duty on a temporary vacancy and his position is not covered by overtime work, the Fire Captain or on the same platoon as the Deputy Chief shall have the option to be compensated at the appropriate rate Acting Deputy Chief to cover such absence, except if such Captain is also absent from duty, the senior Fire Lieutenant on duty on such platoon shall have first option to be the Deputy Chief to cover such absence. Such Fire Captain or such Fire Lieutenant shall receive the first step of the higher class providing Deputy Chief salary range for each tour of duty. For purposes of this Article, a temporary vacancy shall include, but shall not be limited to, absences because of sick leave, vacations, military leave, etc. The Fire Chief shall make every reasonable effort to avoid a transfer which would result in the assignment is for a period loss of not less than four (4) hoursacting pay to an individual serving as an acting officer under this Article. Section 3. A In the absence of the Fire Lieutenant may be Marshal because of Xxxx Leave, Injury Leave, Funeral Leave or Vacation, the Senior Deputy Fire Marshal regularly assigned to fill and on duty in the role Fire Prevention Bureau and who is certified by the Bureau of Paramedic Supervisor without eligibility for acting pay. the State Fire Marshal, shall be the "Acting pay for firefighters filling Fire Lieutenant positionsMarshal", when assigned to the Lifesquad/Ambulance, and shall be paid at the wage rate as described in ARTICLE 36 PARAMEDIC RANK STRUCTURE first (C). All vacant line officer positions shall be filled in accordance with ARTICLE 16 ACTING OFFICERS in a way that preserves pay and benefits for members while providing efficiency in assignments and line operations.
