Action Upon Approval; Implementation Plan. Should the City approve a Development Proposal in whole or in part, then the Developer shall within thirty (30) days then prepare an Implementation Plan for presentation to and approval by the City. The City may engage an independent third party to review the Implementation Plan, the commercially reasonable costs of which shall be paid for or reimbursed by the Developer. The City shall have sixty (60) days from receipt of an Implementation Plan to approve, reject or amend it. The Developer shall have ten (10) days from its receipt of an amended Implementation Plan to either accept or reject the amendment at its option, and shall notify the City in writing within such 10 day period of its acceptance or rejection of such amendment. If it is accepted, then the Implementation Plan as amended shall be considered an approved Implementation Plan for all purposes hereof. If it is rejected, then the original Implementation Plan shall be considered to have been rejected by the City for all purposes hereof. Approval by the City in its sole discretion of the Implementation Plan for an approved Phase shall be a Closing Condition in favor of the City with respect to any Phase.
