Implementation Program. (a) The Borrower shall cause FMOE to maintain NETCOM in form and with functions, staffing and resources satisfactory to the Association.
(b) NETCOM shall meet at least once every quarter and its membership shall include the Federal Minister of Education or his representative as chairman, and representatives of FMOE, UBE, Participating States, and participating Federal agencies.
(a) The Borrower shall maintain the NPCU, headed by a National Project Coordinator, and include an accountant, internal auditor, a procurement officer, and technical staff, all with qualifications and experience satisfactory to the Association.
(b) The NPCU shall be responsible for overall coordination of Project implementation at the Federal level. Staff shall be assigned to the NPCU for the duration of Project implementation and shall not be replaced without informing the Association.
(c) The NPCU shall: (i) prepare for the Project, monthly and quarterly financial reports in form and substance satisfactory to the Association; and (ii) promptly thereafter furnish said reports to the Association.
(d) The UBE National Coordinator will be responsible for monitoring Project implementation at the State level, and for providing technical assistance with Project management, financial management and procurement.
3. For the purpose of ensuring the proper execution of the Project, the Borrower shall cause each Participating State to maintain:
(a) a UBE Advisory Committee;
(b) a PCU to coordinate Project implementation in the respective Participating State, headed by a Project coordinator with qualifications and experience satisfactory to the Association, assisted by a project accountant, technical specialists for implementation, a procurement officer, all with qualifications and terms of reference satisfactory to the Association;
(c) when a PCU is located in the MOE of a Participating State, an additional PIU may be established in the State Primary Education Board of such Participating State.
4. The Borrower shall implement the Project or cause the Project to be implemented in accordance with the Project Implementation Manual and the Financial Management Manual, and, except as the Association shall otherwise agree, the Borrower shall not amend, abrogate or waive any provision thereof which, in the opinion of the Association, may materially and adversely affect the implementation of the Project or the achievement of the objectives of the Project.

Implementation Program. Project Management
Implementation Program. 1. The Borrower shall maintain, until completion of the Project, a Program Steering Committee established within the Ministry of Finance, chaired by the Chief Executive Officer of the Ministry of Finance and comprising of representatives, inter alia, the Ministry of Works, Transport and Infrastructure, Ministry of Natural Resources and Environment, Ministry for Women, Community, and Social Development and community, including two deputy chairpersons, with terms of reference satisfactory to the Association and assigned with such funds, responsibilities and resources as shall be required to enable it to provide overall guidance in the carrying out of the Project, review the progress of Project implementation, assist in achieving the Project objectives and complying with the terms and conditions of this Agreement.
2. The Borrower shall establish and maintain, until completion of the Project, the Project Management Team within the Ministry of Finance, headed by a Project manager, provided with sufficient resources and such responsibilities and funding as shall be required to enable it to carry out the day-to-day management, monitoring and coordination of procurement, accounting, disbursement, financial management and other Project related activities, and reporting to the Program Steering Committee, and staffed with competent personnel in adequate numbers, all under terms of reference acceptable to the Association.
3. The Borrower shall: maintain until completion of the Project, a financial management system for the Project, acceptable to the Association; and not abrogate, amend, assign, repeal, suspend or waive any provisions of the financial management manual without the prior agreement of the Association.
4. The Borrower shall, by March 31, 2005, appoint an independent auditor acceptable to the Association, under terms of reference satisfactory to the Association, to carry out annual audits of Project accounts and financial statements in accordance with the provisions of Section 4.01 of this Agreement.
5. For purposes of carrying out Parts A and B of the Project, the Borrower shall select Project sites in accordance with criteria acceptable to the Association, and, thereafter, implement the respective Parts of the Project in a manner and substance satisfactory to the Association.

Implementation Program. General Implementation Obligations
Implementation Program. 1. The Borrower shall:
(a) maintain policies and procedures adequate to enable it to monitor and evaluate on an ongoing basis, in accordance with the indicators set forth in Schedule 5 to this Agreement, the carrying out of the Project and the achievement of the objectives thereof;
(b) prepare, under terms of reference satisfactory to the Association, and furnish to the Association not later than sixty days after the end of each calendar year of each year of Project implementation, a report integrating the results of the monitoring and evaluation activities performed pursuant to paragraph (a) of this Section, on the progress achieved in the carrying out of the Project during the calendar year preceding the date of said report (provided, however, that the first report to be furnished to the Association shall cover the period from the date of effectiveness, through December 31, 2002), and setting out the measures recommended to ensure the efficient carrying out of the Project and the achievement of the objectives thereof during the period following such date;
(c) review with the Association, within 30 days of submission, or such later date as the Association shall request, the report referred to in paragraph (b) of this Section, and, thereafter, take all measures required to ensure the efficient completion of the Project and the achievement of the objectives thereof, based on the conclusions and recommendations of the said report and the Association’s views on the matter; and
(d) establish a Steering Committee composed of representatives of entities, as agreed with the Association, to provide interagency coordination and guidance for the purposes of Part A of the Project.

Implementation Program. 1. The Borrower shall, for purposes of the Project, maintain the Project Implementation Plan in form and substance satisfactory to the Association, and shall carry out the Project in accordance with said Plan. Except as the Association shall otherwise agree, the Borrower shall not amend or waive any provision of the Project Implementation Plan if, in the opinion of the Association, such amendment or waiver may materially and adversely affect the carrying out of the Project or the achievement of the objectives thereof.
2. The Borrower shall ensure that a financial management specialist and a procurement specialist, both suitably qualified and experienced and acceptable to the Association, will be assigned to the Project throughout its execution.
3. The Borrower shall ensure that its MoLHR and MoE will collaborate on carrying out the tracer study and employer/establishment surveys required for the purposes of Part C.3(b) of the Project, under arrangements satisfactory to the Association set out in a memorandum of understanding to be entered into between MoLHR and MoE not later than October 31, 2003.
4. The Borrower shall implement, in a manner satisfactory to the Association, the environmental mitigation, monitoring and other measures set forth in the Environmental Management Plan in accordance with the objectives, policies, procedures, time schedule and other provisions set forth therein, and shall not take or permit to be taken any action which would prevent or interfere with such implementation.
5. The Borrower shall ensure that, throughout the execution of the Project, local communities benefiting under the Project will continue to be duly consulted in accordance with the Peoples Consultation Plan.
6. The Borrower shall ensure that Innovation Grants shall be made to the Beneficiaries in accordance with the Project Implementation Plan, under guidelines acceptable to the Association.
7. The Borrower shall:
(a) maintain policies and procedures adequate to enable it to monitor and evaluate on an ongoing basis, in accordance with indicators satisfactory to the Association, the carrying out of the Project and the achievement of the objectives thereof;

(b) prepare, under terms of reference satisfactory to the Association, and furnish to the Association, on or about December 31, 2005, a report integrating the results of the monitoring and evaluation activities performed pursuant to paragraph (a) of this Section, on the progress achieved in the carrying out of the Project during the period preceding the date of said report and setting out the measures recommended to ensure the efficient carrying out of the Project and the achievement of the objectives thereof during the period following such date; and
(c) review with the Association, by March 31, 2006, or such later date as the Association shall request, the report referred to in paragraph (b) of this Section, and, thereafter, take all measures required to ensure the efficient completion of the Project and the achievement of the objectives thereof, based on the conclusions and recommendations of the said report and the Association’s views on the matter.
2. The Borrower shall prepare and submit to the Association an annual training plan for the Project by September 30 in each year.
3. The Borrower shall take or cause to be taken, all measures necessary for the carrying out of the Environmental Management Plan in a timely manner.
4. By June 30, 2004, the Borrower shall carry out and submit to the Association, a report on expenditure and financing options for the development of its education sector, acceptable to the Association.
5. By October 30 of each year, the Borrower shall review and allocate adequate budgetary resources necessary for the implementation of the Project for the following year.
6. By January 31, 2005, the Borrower shall introduce a per capita budgeting system in one district as a pilot and submit to the Association the budget based on a per capita budgeting system.

1. The Recipient shall:
(a) maintain policies and procedures adequate to enable it to monitor and evaluate on an ongoing basis, in accordance with the indicators set forth in Schedule 6 to this Agreement, the carrying out of the Project and the achievement of the objectives thereof;
(b) prepare, under terms of reference satisfactory to the Association, and furnish to the Association, on or about December 31, 2004, a report integrating the results of the monitoring and evaluation activities performed pursuant to paragraph (a) of this Section, on the progress achieved in the carrying out of the Project during the period preceding the date of said report and setting out the measures recommended to ensure the efficient carrying out of the Project and the achievement of the objectives thereof during the period following such date; and
(c) review with the Association, by March 31, 2005 or such later date as the Association shall request, the report referred to in paragraph (b) of this Section, and, thereafter, take all measures required to ensure the efficient completion of the Project and the achievement of the objectives thereof, based on the conclusions and recommendations of the said report and the Association’s views on the matter.
(a) The Recipient shall establish and maintain within FSD of MRD, until the completion of the Project, the Project Management Unit which shall report to the Head of FSD. The PMU shall consist of a number of key staff, appointed in accordance with the provisions of Section II of Schedule 3 to this Agreement, including a Project Coordinator, a Financial Management Officer, a Procurement Officer, a Rural Engineer and an Officer in charge of Monitoring and Evaluation.
(b) The PMU shall be responsible for: (i) the overall coordination regarding the implementation of the different Parts of the Project; (ii) the financial management of the Project, including the auditing and accounting thereof (iii) the setting-up and implementation of a monitoring and evaluation system; (iv) the building of capacity at Woreda level to administer and manage emergency recovery activities and (v) the administrative management of the Project, including procurement activities .
