Common use of Active Military Service Clause in Contracts

Active Military Service. Vacation Accrual during Leave and Cash-Out of Accrued Vacation at Commencement of Leave Unit members called into active military service (other than temporary military service) shall, following their qualifying year of service for vacation, continue to accrue vacation during their military service, subject to the same maximum accrual requirements as active City employees. To avoid reaching maximum accrual during an extended leave, employees may request cash payment of accrued, but unused vacation time as of the date of the commencement of their military leave. Such request may be for all accrued time or a portion of their accrued time. The request for any cash payment must be made prior to the employee’s first day of their leave of absence. Military orders or other evidence of call-up into the armed forces of the United States must be submitted with the request.
