Additional Insured and Waiver of Subrogation. The Company agrees to cause the relevant insurance policies and cover notes being maintained at the expense of the Company for the benefit of both parties to include both parties as named insureds and to cause the interested underwriters to waive all rights of subrogation against the parties hereto.

The Commercial General Liability Policy additional insured coverage shall be provided on ISO Endorsement Form CG 2010 (11/85) or the combination of CG 20 10 (2004) and CG 20 37 (2004) or equivalent as determined and approved by Owner, and a copy of such endorsement shall be attached to the required Certificate of Insurance. Additional Insured Endorsements that limit coverage to less than what is required by this Trade Contract will not be accepted unless otherwise limited by applicable law. Trade Contractor will provide additional insured coverage to the fullest extent permitted by applicable law. Commercial General Liability policies shall contain endorsements waiving all rights of subrogation against all additional insureds.

The Vendor shall name the City of Aurora, its elected and appointed officials, employees, agents and representatives as additional insureds by endorsement and provide a waiver of subrogation for the Commercial General Liability, Auto Liability and Excess Liability insurance policies.
