Common use of Additional Paid Sick Leave Clause in Contracts

Additional Paid Sick Leave. 11.5.1 After exhaustion of paid sick leave, an employee who is ill, injured or disabled may, upon submission, use accumulated vacation leave to avoid leave without pay. 11.5.2 Per Ed Code 88196, regular classified employees shall be credited once a year with a total of not less than one hundred (100) working days of paid sick leave, including days to which he or she is entitled under Section 88191. These days of paid sick leave, in addition to those required by Section 88191, shall be compensated at not less than fifty percent (50%) of the employee’s regular salary. The paid sick leave authorized under such a rule shall be exclusive of any other paid leave, holidays, vacation, or compensating time to which the employee may be entitled. 11.5.3 When all applicable leaves of absence, paid or unpaid, have been exhausted, and if the employeeis not medically able to assume the duties of the employee's position, the employee shall, if not placed in another position, be placed on a re-employment list for a period of thirty-nine (39) months.
