Admissions and Occupancy Policies Regarding Public Housing Units. The Authority and the Developer acknowledge that the goal of achieving long-term sustainability of each Rental Phase as a mixed-income community will be enhanced by administrative procedures and terms and conditions of occupancy that reduce discernible distinctions in maintenance, operation and conditions of continued occupancy, between the Public Housing Units and the other units in the Rental Phase to the greatest extent feasible while assuring that the Public Housing Units are available for housing families who meet the occupancy objectives of the Authority. The selection of applicants for admission to and continued occupancy of rental units in each Rental Phase, including the Public Housing Units, shall be the function of the Owner Entity. Admission to and continued occupancy of Public Housing Units shall be limited to persons or families eligible for public housing under the Act and HUD regulations, as limited further, during the compliance period and any extended use period, by applicable restrictions under Section 42 of the Internal Revenue Code. Subject to the terms of the preceding sentence, “Displaced Residents” (as defined in the Lone Star Settlement Agreement) will be given a first preference for initial occupancy of public housing units included in each Rental Phase. The Authority and the Developer shall mutually review and approve all occupancy and re-occupancy policies (including, without limitation, (i) work preferences, (ii) screening policies, and (iii) income-tiering policies)). The Rental Owner Entity, subject to delegation to the Management Agent, shall carry out all administrative functions in connection with admission of applicants to occupancy of the Public Housing Units, including pre-application and application intake, applicant interview and screening, verification procedures, determination of eligibility for admission and qualification for preference, record maintenance, waiting list maintenance, unit assignment and execution of leases, all in accordance with criteria and procedures approved by the Authority. The Authority shall authorize the Rental Owner Entity to maintain a site-based waiting list and shall include a description of the site-based waiting list and admission procedures and policies applicable to the Public Housing Units in each Phase in its annual plan.   • Operations Logs Seller shall maintain a complete and accurate log of all material operations and maintenance information on a daily basis. Such log shall include, but not be limited to, information on power production, fuel consumption, efficiency, availability, maintenance performed, outages, results of inspections, manufacturer recommended services, replacements, electrical characteristics of the generators, control settings or adjustments of equipment and protective devices. Seller shall maintain this information for at least two (2) years and shall provide this information electronically to Buyer within one day of Buyer’s request.

  • PUBLIC WORKS AND BUILDING SERVICES CONTRACTS Work being done under a resulting Authorized User Agreement may be subject to the prevailing wage rate provisions of the New York State Labor Law. SHORT TERM EXTENSION In the event a replacement Contract has not been issued, any Contract let and awarded hereunder by the State, may be extended unilaterally by the State for an additional period of up to 3 months upon notice to the Contractor with the same terms and conditions as the original Contract including, but not limited to, prices and delivery requirements. With the concurrence of the Contractor, the extension may be for a period of up to 6 months in lieu of 3 months. However, this extension terminates should the replacement Contract be issued in the interim. PROCUREMENT INSTRUCTIONS Authorized Users should refer to the documents attached as Appendix G – Processes and Forms Templates for specific instructions on the usage of this Contract. OGS reserves the right to unilaterally make revisions, changes, additions and/or updates to the documents attached as Appendix G - Processes and Forms Templates without processing a formal amendment and/or modification. SPECIFICATIONS During the term of the Contract, the Authorized User may request Product specifications for particular items that have been included by the Contractor in its Pricing Pages. These specifications will be provided by the Contractor at no cost.

  • Surveys, Permits, and Regulations The Owner shall furnish all surveys unless otherwise specified. Permits and licenses of a temporary nature necessary for the prosecution of the Work shall be obtained and paid for by the Contractor. Permits, licenses, and easements for permanent structures or permanent changes in existing facilities shall be obtained and paid for by the Owner unless otherwise specified. The Contractor and its Subcontractors must pay any municipal or county occupational licenses, taxes, or fees, if any. The Contractor shall give all notices and comply with all laws, ordinances, rules, and regulations bearing on the conduct of the Work. If the Contractor observes that the drawings or specifications are at variance with any such laws, ordinances, rules or regulations, he shall promptly notify the Owner in writing, and any necessary changes shall be adjusted as provided in the Contract for changes in the Work. If the Contractor performs any Work knowing it to be contrary to such laws, ordinances, rules or regulations without such notice to the Owner, he shall bear all costs arising therefrom. Nothing in this paragraph shall be construed to impose design responsibility on the Contractor except as noted in the Contract Documents.
