Agreement to Lease Premises. City hereby leases to Tenant and Tenant hereby leases from City that certain real property described in Exhibit A together with the improvements constructed thereon by City (the "Premises"). City has authority to lease such Premises. Tenant agrees to accept the Premises “as is,” and City makes no warranty as to the condition of the Premises or their suitability for any particular purpose.

Subject to, and upon, the terms and conditions set forth in this Agreement, the Lessor hereby subleases the Premises to Sublessee effective March 1, 2011 and Sublessee hereby subleases the Premises from the Lessor. Tenant is prohibited from recording any document with the Washington County Recorder’s Office regarding the Premises without the express written consent of the City. See Sec. 8.A-8.C herein.

On multi- tenant floors, common corridors and toilets, air conditioning rooms, fan rooms, janitorial closets, electrical and telephone closets and any other areas within and exclusively serving that floor are considered common area and for purposes of this section shall be allocated prorate to the Tenants on the floor.
