Agreement to Pay Housing Assistance Payments during Extended HAP Payment Period. In the event Authority terminates the HAP Contract pursuant to [paragraph d.ii.3] of the HAP Contract at a time after the tenth (10th) anniversary of the HAP Contract because sufficient appropriated funds are not available from HUD pursuant to the terms of the HAP Contract, then for a period commencing on the date of such termination of the HAP Contract after the 10th anniversary thereof (11th year) and ending not later than the fifteenth (15th) anniversary of the HAP Contract (as if it had continued) (such years 11 through 15 are referred to herein as the “Extended HAP Payment Period”), Agency agrees to pay and subsidize the rental income gap in a cumulative amount not exceeding (but which may be less than) Seven Hundred Thousand Dollars ($700,000) (“HAP Commitment Subsidy”), allocated as follows: (a) an amount not to exceed Five Hundred Forty Thousand Dollars ($540,000) for transition years 11 and 12, and (b) the remaining balance of One Hundred Sixty Thousand Dollars ($160,000) available and allocable for the remainder of the Extended HAP Payment Period, specifically years 13, 14, and 15.
