Agricultural Mitigation Payment. (a) Seller agrees to make the Agricultural Mitigation Payment to a fund designated by NYSERDA within sixty (60) days of the date upon which the Bid Facility is granted Operational Certification. The final amount of the Agricultural Mitigation Payment shall be determined by NYSERDA in cooperation with Seller through the Operational Certification process. Xxxxxx agrees to adhere to the Agricultural Mitigation Payment calculation methodology, as depicted for the proposed Bid Facility in Exhibit H and detailed in RESRFP22-1.
