Indigenous Peoples. The Borrower shall, and shall cause MOT and ARS to, ensure that the Project does not cause any impact on indigenous people within the meaning of the SPS. In the event that the Project does have any such impact, the Borrower shall, and shall cause MOT and ARS to, take all steps required to ensure that the Project complies with the applicable laws and any other applicable regulations of the Borrower and the SPS.

Indigenous Peoples. The Borrower shall ensure and cause the Project Executing Agency to ensure that the preparation, design, construction, implementation and operation of the Project comply with (a) all applicable laws and regulations of the Borrower relating to indigenous peoples; (b) the Indigenous Peoples Safeguards; and (c) all measures and requirements set forth in any indigenous people’s plan, and any corrective or preventative actions set forth in a Safeguards Monitoring Report.
Indigenous Peoples ownership and custody of their heritage is collective, permanent, and inalienable as prescribed by the customs, rules, and practices of each people.
Indigenous Peoples. The Borrower shall cause each Qualified Enterprise to ensure that Qualified Projects do not adversely affect vulnerable groups, such as indigenous peoples, and in the event of any impact or their involvement, the Borrower shall cause each Qualified Enterprise to implement the social safeguards framework as set out in the ESSF in accordance with its terms to ensure compliance with ADB’s Policy on Indigenous Peoples (1998).
Indigenous Peoples. The Borrower shall ensure, or cause the EA to ensure, that in the preparation, design, construction, implementation and operation of the Project, each Subproject and all Project facilities comply with (a) all applicable laws and regulations of the Borrower and the State relating to indigenous peoples; (b) the Indigenous Peoples Safeguards; (c) the IPPF; and (d) all measures and requirements set forth in the respective IPP, and any corrective or preventative actions set forth in a Safeguards Monitoring Report.

In the event that the Project does have any such impact, the Borrower shall ensure or cause the State and the DISCOMs to ensure that the preparation, design, construction, implementation and operation of the relevant Subproject(s) comply with (a) all applicable laws and regulations of the Borrower relating to indigenous peoples; (b) the Indigenous Peoples Safeguards; (c) the IPPF; and (d) all measures and requirements set forth in the relevant IPP, and any corrective or preventative actions set forth in a Safeguards Monitoring Report.

Indigenous Peoples. The Borrower shall, when applicable in accordance with the provisions of the Indigenous Peoples’ Framework: (a) furnish to the Bank for its approval an Indigenous Peoples’ Plan for each Subproject; and (b) carry out the requirements specified by such Indigenous Peoples’ Plan in accordance with its terms.

Indigenous Peoples. The Recipient shall ensure that the Project does not have any indigenous peoples impacts within the meaning of SPS. In the event that the Project does have any such impact, the Recipient shall take, or cause the Project Executing Agency to take, all steps required to ensure that the Project complies with the applicable laws and regulations of the Recipient and with the principles and requirements set forth in Chapter V, Appendix 3 and Appendix 4 (as applicable) of the SPS.
