Air Carrier Certification. The Company (A) is an “air carrier” within the meaning of 49 U.S.C. Section 40102(a)(2), (B) holds an air carrier operating certificate issued by the Secretary of Transportation pursuant to Chapter 447 of Title 49 of the United States Code for aircraft capable of carrying 10 or more individuals or 6,000 pounds or more of cargo and (C) is a “citizen of the United States” as defined in 49 U.S.C. Section 40102(a)(15).
Air Carrier Certification. American, a wholly owned subsidiary of the Company, (i) is an "air carrier" within the meaning of 49 U.S.C. Section 40102(a), (ii) holds an air carrier operating certificate issued by the Secretary of Transportation pursuant to Chapter 447 of Title 49 of the Unites States Code for aircraft capable of carrying 10 or more individuals or 6,000 pounds or more of cargo, and (iii) is a "citizen of the United States" as defined in 49 U.S.C. 40102.
Air Carrier Certification. The Guarantor, a wholly owned subsidiary of the Company, (i) is an “air carrier” within the meaning of 49 U.S.C. Section 40102(a), (ii) holds an air carrier operating certificate issued by the Secretary of Transportation pursuant to Chapter 447 of Title 49 of the United States Code for aircraft capable of carrying 10 or more individuals or 6,000 pounds or more of cargo, and (iii) is a “citizen of the United States” as defined in 49 U.S.C. 40102.

All of the outstanding capital stock of American has been duly authorized and validly issued and is fully paid and non-assessable and is owned by the Company, directly or indirectly through subsidiaries, free and clear of any recorded liens, encumbrances, equities or claims.

Each of SkyWest Airlines, Inc. and ASA, each a wholly-owned subsidiary of the Company, is a "citizen of the United States" (as defined in Section 40102(a)(15) of Title 49 of the United States Code, as amended) and is an air carrier operating under a certificate of public convenience and necessity issued by the Secretary of Transportation pursuant to Section 41102 of Xxxxx 00, Xxxxxx Xxxxxx Code. There is in force with respect to each of SkyWest Airlines, Inc. and ASA an air carrier operating certificate issued by the Federal Aviation Administration pursuant to 14 C.F.R. Part 119.

Chautauqua Airlines, Inc., a wholly owned subsidiary of the Company, is a “citizen of the United States” (as defined in Section 40102(a)(15) of Title 49 of the United States Code, as amended) and is an air carrier operating under a certificate of public convenience and necessity issued by the Secretary of Transportation pursuant to Section 41102 of Txxxx 00, Xxxxxx Xxxxxx Code. There is in force with respect to Chautauqua Airlines, Inc. an air carrier operating certificate issued by the Federal Aviation Administration pursuant to 14 C.F.R. Part 119.
Air Carrier Certification. Each of Chautauqua Airlines, Inc., Republic Airline Inc. and Shuttle America Corporation, each a wholly owned subsidiary of the Company, is a “citizen of the United States” (as defined in Section 40102(a)(15) of Title 49 of the United States Code, as amended) and is an air carrier operating under a certificate of public convenience and necessity issued by the Secretary of Transportation pursuant to Section 41102 of Xxxxx 00, Xxxxxx Xxxxxx Code. There is in force with respect to each of Chautauqua Airlines, Inc., Republic Airline Inc. and Shuttle America Corporation an air carrier operating certificate issued by the Federal Aviation Administration pursuant to 14 C.F.R. Part 119.
Air Carrier Certification. AirTran shall be an air carrier certificated under applicable Law and shall not have received notice from the United States Department of Transportation (the “DOT”) or the United States Federal Aviation Administration (the “FAA”) of any loss of such certification or that any investigation by the DOT or FAA has been commenced in relation to the potential revocation of such certification.
Air Carrier Certification. The Borrower, in compliance with 14 C.F.R. 49.53(a)(1) and (2), certifies that the Borrower is an air carrier, certificated by the FAA under 49 U.S.C. 44705, and that the Pledged Spare Parts are maintained by or on behalf of the Borrower at the Designated Locations. Air Carrier Certification. Mesaba holds an Air Carrier Operating Certificate issued by the Federal Aviation Administration, a Certificate of Public Convenience and Necessity issued by the U.S. Department of Transportation and all other operating and airworthiness certificates necessary for its operation.
