Alcoholic Beverages and Tobacco Sales. During the term of this Agreement alcoholic beverages may be served at the Facility if permissible in accordance with applicable law. The parties acknowledge that no enabling Band legislation for the sale of alcoholic beverages is now in force, and that such legislation would be necessary in order to serve alcoholic beverages at the Facility. If such legislation is subsequently enacted, and if other requisite approvals are obtained, the Band and Manager may mutually agree to include service of such beverages within the Enterprise. Tobacco may be sold at the Facility subject to and in accordance with the Band's licensing requirements, if any.
Alcoholic Beverages and Tobacco Sales. During the term of this Agreement, alcoholic beverages shall be sold and served at the Facility in accordance with Legal Requirements. The Parties acknowledge that enabling Tribal legislation for the sale of alcoholic beverages is required, and that such legislation will be necessary in order to serve alcoholic beverages at the Facility. The Tribe agrees to enact and perfect such legislation, and use best efforts to obtain any and all other requisite approvals as soon as possible, including, without limitation, publication of such legislation governing the sale of alcoholic beverages in the Federal Register, pursuant to 18 U.S.C. §1154 and §1161, but in no event later than thirty (30) days prior to the Opening Date. The Tribe and Manager hereby mutually agree to include service of such beverages within the Facility. Tobacco shall also be sold at the Facility, subject to and in accordance with the Tribe’s licensing requirements, if any.

Alcoholic beverages may be served for individual consumption at the Gaming Facility, if permissible subject to and in accordance with the Compact, the Authority's licensing requirements, other applicable law and the Local Agreements. Tobacco may be sold for individual consumption at the Gaming Facility subject to and in accordance with the Authority's licensing requirements, other applicable law, and the Local Agreements.
Alcoholic Beverages and Tobacco Sales. During the term of this Agreement, no alcoholic beverages shall be served on the Property, unless the Business Committee, on behalf of the Tribe, and Manager mutually agree to the serving of such beverages, and unless the serving of such beverage is otherwise in accordance with applicable law. Tobacco may be sold at the Gaming Operation by the Tribe if such sale is in accordance with the provisions of applicable law and with any agreements between the Tribe and any agency thereof and any other governmental entity. The revenues of any such tobacco sales shall be revenues of the Tribe, exclusively. The operation and all employees shall be under the direction of the Tribe; however, such employees shall meet the standards imposed by Manager on other employees of the Gaming Operation.

The Authority and Manager hereby mutually agree to include service of such beverages within the Facility. Tobacco may also be sold at the Facility subject to and in accordance with the Tribe’s licensing requirements, if any.
Alcoholic Beverages and Tobacco Sales. No Tribal legislation prohibiting the sale of tobacco and/or alcoholic beverages is now in force, and no such legislation will be enacted during the term of this Agreement. The Tribe agrees to enact any Tribal legislation necessary to allow sale of alcoholic beverages or tobacco products in the facility. The Enterprise and Manager mutually agree to include sale of tobacco and alcoholic beverages within the Facility to the fullest extent allowed by the Compact.

If such legislation is subsequently enacted, and if other requisite written approvals are obtained, SHINGLE SPRINGS and a KAR may mutually agree to include service of such beverages within the Enterprise. Tobacco may be sold at the Facility subject to and in accordance with SHINGLE SPRINGS's licensing requirements, if any.
