Allocation and Use. Of the total sum of FOUR HUNDRED TWENTY-FOUR THOUSAND EIGHT HUNDRED FIFTY DOLLARS ($424,850.00)FOUR HUNDRED THIRTY-FOUR THOUSAND FOUR HUNDRED THIRTY-THREE DOLLARS ($434,433.00) of Hotel Tax Revenues to be paid to DBA under this Agreement, the sum of ONE HUNDRED TEN THOUSAND DOLLARS ($110,000.00) shall be allocated for the Texas Reds Festival. The remaining THREE HUNDRED FOURTEEN THOUSAND EIGHT HUNDRED FIFTY DOLLARS ($314,850.00)THREE HUNDRED TWENTY-FOUR THOUSAND FOUR HUNDRED THIRTY-THREE DOLLARS ($324,433.00) of Hotel Tax Revenues, not allocated to the Texas Reds Festival, shall be used for: (i) that portion of the salaries of DBA employees that is directly attributable to the performance of the services and activities set forth in this Agreement, which services or activities are authorized uses of Hotel Tax Revenues under Chapter 351 of the Texas Tax Code, in an amount not to exceed the approved budget amount, and (ii) for marketing and promotional expenditures necessary for the performance of this Agreement that are allowable under the requirements of Chapter 351 of the Texas Tax Code, in an amount not to exceed the Approved Budget; and for no other purposes.
